STATEMENT OF FACTS
THE FACTS
The applicant is a Kyrgyz national who suffers from a severe medical condition and is in need of regular, life-sustaning treatment. He claims that he will not receive this treatment within adequate time in his country of origin. After arriving in Sweden, he applied for asylum.
COMPLAINT
The applicant complains under Article 3 of the Convention that, if deported from Sweden to Kyrgyzstan, he would not receive adequate medical treatment for his illness in Kyrgyzstan and would thus die within a few weeks.
QUESTION TO THE PARTIES
In light of the applicant’s health condition, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention if the deportation order were implemented?
