LORD JUSTICE KENNEDY:
"This agreement may be brought to an end (but not earlier than the expiry of the term certain) by the tenant giving to the landlord at least one calendar month's written notice."
"If an assured tenancy which is a fixed term tenancy comes to an end.....then.....the tenant shall be entitled to remain in possession of the dwelling house let under that tenancy and.....his right to possession shall depend on a periodic tenancy arising by virtue of this section."
"An assured tenancy which
(a).....
(b) comes into being by virtue of Section 5 above on the coming to an end of an assured tenancy is an assured tenancy."
"(d) ..... the periods of the tenancy are the same as those for which rent was last payable under the fixed term tenancy; and
(e).....the other terms are the same as those of the fixed term tenancy immediately before it came to an end except that any term which makes provision for determination by the landlord or the tenant shall not have effect while the tenancy remains an assured tenancy."
"A periodic tenancy is one which continues from period to period until determined by proper notice."
".....no notice by a tenant to quit any premises let as a dwelling shall be valid unless
(a) it is in writing and contains such information as may be prescribed, and -
(b) it is given not less than four weeks before the date in which it is to take effect."
"So there was, therefore, a surrender on that day."
