  1. LORD JUSTICE BUXTON: This is an application for permission to appeal against an order of the Divisional Court on 14th June 2001 imposing a vexatious litigant order upon Mr Boothe-Chambers. He was notified of the date and time of this hearing by letter from the Civil Appeals Office on 17th August 2001. There has, I am told, been no response from him and he has not attended this morning.

  2. In those circumstances the court will strike out this application for want of prosecution subject to this. The order will be served on Mr Boothe-Chambers by first class post and it will lie in the office for 14 days to allow Mr Boothe-Chambers to make any submissions that he may consider appropriate as to whether the order should be reconsidered. I should emphasise that he will need to produce cogent reasons why he has not attended today before the court reconsiders the matter, but in my judgement, as he is a litigant in person, he ought to have that licence.
  3. The order therefore is that the application is dismissed for wanted of prosecution. It will lie in the office for 14 days, subject to any further submissions Mr Boothe-Chambers may wish to make.
  4. ORDER: Application dismissed.
