1. LORD JUSTICE LATHAM: This is a restored application by the applicant for permission to appeal against the judgment of Hunt J from 15 November 2,000. The matter was initially before the court on 31 January 2001 when Simon Brown LJ, in the absence of the applicant but in a reasoned judgment, dismissed the application.
2. The applicant has not appeared this morning. It does not seem to me that it would be profitable for me to do any more than say that I entirely agree with the conclusion of Simon Brown LJ that this application for permission should be refused. I do so for the same reasons that he gave.
3. There is no need for me to say more in this case.
