THE DECISION TO REFUSE PERMISSION TO
CLAIM FOR JUDICIAL REVIEW AND AN
EXTENSION OF TIME

		Royal Courts of Justice Strand London WC2 Tuesday, 16th July 2002

1. LORD JUSTICE KENNEDY: This matter is listed before me today as a renewed application for permission to seek judicial review, permission having been refused by Mr Justice Lightman on 19th March 2002 after an oral hearing and permission having previously been refused on paper.
2. Dr Uruakpa sought to have today's hearing adjourned last week for reasons unconnected with his health. That application was refused by Master Venne. He then submitted by fax a medical certificate indicating that he was unfit to travel. The document was not convincing on the face of it and that did not lead to an adjournment of today's hearing. There has now been placed before me a medical certificate which is in a more convincing form. It is a letter from a general practitioner bearing today's date which reads thus:

"This gentleman has symptoms of nerve root entrapment in his leg and is unable to make the journey to London on 16th July 2002."

3. The certificate, it will be observed, gives no indication as to when he will be fit to make the journey to London.
4. The case will because of that certificate be taken out of today's list. It will be regarded as available for relisting from Monday next week.
