Peter Noble v (1) Rodney Hamer (2) Janet Hamer (Adverse possession : Applications under Schedule 6 to the Land Registration Act 2002) [2017] UKFTT 638 (PC) (07 July 2017)
Application to register title to a garden plot, behind a curiously laid out terrace of houses, by virtue of adverse possession. Held that he had been in possession by agreement with the registered proprietor, so that adverse possession was not made out; in any event, the registered proprietors objected and the applicant could not have made out any of the Schedule 6 conditions so as to be entitled to registration.
