(1) Paul William Carson (2) Eirene Jane Carson v (1) Paolo Giuseppe Olivier (2) Rossana Pugglione Olivier (Boundary dispute : Inferences to be drawn from surrounding circumstances) [2018] UKFTT 172 (PC) (21 February 2018)
[2018] UKFTT 0172 (PC). In issue: a) the ownership of a small area of land (‘the triangle’) between neighbouring properties and b) and as to the position of the remainder of the boundary. HELD that Respondents had held paper title to triangle but the Applicants had acquired it by adverse possession under the transitional provisions. Findings of fact made as to the remainder of the boundary, but no direction to Chief Land Registrar made as the relevant had not been referred to the Tribunal (though the parties believed it had been) and because in any event this should have been an application for a determined boundary.
