Wood v. Wood [1998] IESC 8 (2nd July, 1998)

THE SUPREME COURT

137/98

O‘FLAHERTY J

LYNCH J

BARRON J

BETWEEN:

WOOD

AND

WOOD

Ex TEMPORE JUDGMENT DELIVERED THE 2ND DAY OF JULY 1998 BY LYNCH J

1. The Court has heard submissions from Mrs Wood and has also read the papers which she submitted to the Court including her affidavit. The Court has a great deal of sympathy for her and her daughter Fiona who is now 26 years old. They are joint tenants of a flat. However, even though we have sympathy, in the absence of Bray Urban District Council we are not in a position to make any form of order or direction to them. It appears that in the area where Mrs Wood and her daughter live there are a number of young men who regularly create a nuisance and she does not appear to be the only victim. Other responsible residents in the area suffer from the same sort of nuisance. All we can suggest is that Mrs Wood again contact the Gardai and Bray Urban District Council and I would in conclusion just remark that these observations which I am making are at the moment being recorded. They will in due course be typed up and a copy of them will be made available to Mrs Wood and she may make use as she thinks fit of it in representations to the Gardai and Bray Urban District Council.
