WEIGHTS AND MEASURES (VERIFICATION AND STAMPING FEES) ORDER, 1929. | ||||||||||||||||||||||||||||||||||||||
WHEREAS it is (amongst other things) enacted by Section 9 of the Weights and Measures Act, 1904, that it shall be lawful for His Majesty, by Order in Council, to specify new fees to be paid in respect of the verification and stamping of weights, measures and weighing and measuring instruments in substitution for the fees specified in the First Schedule to the Weights and Measures Act, 1889, and that any Order in Council so made may be varied or revoked by a subsequent Order in Council : | ||||||||||||||||||||||||||||||||||||||
AND WHEREAS in exercise of the powers conferred by the said Weights and Measures Act, 1889, an Order in Council was made on the 26th day of April, 1920 : | ||||||||||||||||||||||||||||||||||||||
AND WHEREAS it is enacted by Section 10 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922) that whenever it is provided in any British Statute that any act or thing shall or may be made or done by Order in Council, then every such act or thing may be made or done in Saorstát Eireann by an Order of the Governor-General of the Irish Free State upon the advice of the Executive Council of the Irish Free State : | ||||||||||||||||||||||||||||||||||||||
AND WHEREAS the said Weights and Measures Act, 1904, is a British Statute within the meaning of the said Adaptation of Enactments Act, 1922 : | ||||||||||||||||||||||||||||||||||||||
AND WHEREAS the said Order in Council of the 26th day of April, 1920, was varied by an Order entitled the Weights and Measures (Alteration of Fees) Order, 1926, made by the Governor-General of the Irish Free State acting on the advice of the Executive Council of the Irish Free State on the 23rd day of April, 1926, and the said Order in Council of the 26th day of April, 1920, as so amended has the force of law in Saorstát Eireann : | ||||||||||||||||||||||||||||||||||||||
AND WHEREAS it is expedient to revoke the said Order in Council of the 26th day of April, 1920, and the Weights and Measures (Alteration of Fees) Order, 1926, and to specify new fees to be taken in respect of the verification and stamping of the weights, measures and weighing and measuring instruments mentioned in the Schedule hereto : | ||||||||||||||||||||||||||||||||||||||
NOW I, JAMES McNEILL, Governor-General of the Irish Free State, acting on the advice of the Executive Council of the Irish Free State, and in exercise of the powers in this behalf conferred on me by the joint operation of section 9 of the Weights and Measures Act, 1904, and section 10 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power me in this behalf enabling, do hereby order as follows :— | ||||||||||||||||||||||||||||||||||||||
1. This Order may be cited for all purposes as the Weights and Measures (Verification and Stamping Fees) Order, 1929, and shall come into operation on the 1st day of July, 1929. | ||||||||||||||||||||||||||||||||||||||
2. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924. | ||||||||||||||||||||||||||||||||||||||
3. The fees specified in the Schedule hereto shall be taken in respect of the verification and stamping by inspectors of weights and measures of the weights, measures, and weighing and measuring instruments mentioned in the said Schedule. | ||||||||||||||||||||||||||||||||||||||
4. The Order in Council made under Section 9 of the Weights and Measures Act, 1904, on the 26th day of April, 1920, and the Weights and Measures (Alteration of Fees) Order, 1926, are hereby revoked. | ||||||||||||||||||||||||||||||||||||||

SCHEDULE. | ||||||||||||||||||||||||||||||||||||||
WEIGHTS AND MEASURES. | ||||||||||||||||||||||||||||||||||||||

Measures of Capacity (not being Bottles of a size for the time being prescribed under Section 9 of the Intoxicating Liquor (General Act, 1924 (No. 62 of 1924) for the sale of intoxicating liquor or any particular kind of intoxicating liquor in bottle) :— | ||||||||||||||||||||||||||||||||||||||

Provided that where quantities of one gross or more unsubdivided measures of a capacity not exceeding one pint, are submitted for verification, the fee payable shall be 1s. 3d. per dozen. | ||||||||||||||||||||||||||||||||||||||
Graduated: | ||||||||||||||||||||||||||||||||||||||
On the verification and stamping of graduated liquid measures, double the above fee in the appropriate case is to be paid. | ||||||||||||||||||||||||||||||||||||||

On the verification and stamping of a metric weight, measure, or instrument, the fee shall be that which is prescribed in this Schedule, with respect to the equivalent in weight, measure, or capacity. | ||||||||||||||||||||||||||||||||||||||
Where any instrument has two sets of graduations of different form, double the appropriate fee is payable. | ||||||||||||||||||||||||||||||||||||||
Where, in a weighing instrument, two weigh tables or platforms are connected to one steelyard or office mechanism, two separate fees, in accordance with the capacities of the respective weigh tables or platforms, are payable. | ||||||||||||||||||||||||||||||||||||||
In the case of a weighing or measuring instrument constructed also to calculate and indicate the price in money, an additional fee is payable for the examination of the price indicating mechanism equal in amount to that charged on the weighing instrument. | ||||||||||||||||||||||||||||||||||||||
Where any weighing or measuring instrument is required by the Weights and Measures (General) Regulations, 1928, to be verified in situ, or where there is compliance with an application for the verification in situ of a weighing or measuring instrument which is not required by the said regulations to be so verified, the appropriate fee shall be payable in addition to the cost of transport of the required standards and the travelling expenses of the inspector between the nearest Weights and Measures Office and the place at which the verification is made. | ||||||||||||||||||||||||||||||||||||||
