COPYRIGHT (IRISH TRANSLATIONS) (UNITED STATES OF AMERICA), ORDER, 1929.

COPYRIGHT (IRISH TRANSLATIONS) (UNITED STATES OF AMERICA), ORDER, 1929.

WHEREAS it is enacted by paragraph (a) of sub-section (2) of section 154 of the Industrial and Commercial Property (Protection) Act, 1927 (No. 16 of 1927), as amended by section 10 of the Industrial and Commercial Property (Protection) (Amendment) Act, 1929 (No. 13 of 1929), that, for the purposes of Part VI. of the first-mentioned Act, "copyright" shall include the sole right to produce, reproduce, perform, or publish any translation of the work but the said paragraph (a) as so amended, contains a proviso that such right (save as respects the performance of translations of dramatic or musical works) shall, as regards translations into the Irish language, cease after the period therein mentioned and that the Governor-General may by order made on the advice of the Executive Council exclude from the operation of that proviso all or any class or classes of works, the authors of which were at the date of the making of such works citizens of any country not a party to the International Union for the protection of Literary and Artistic Works which the Governor-General on the advice aforesaid shall think fit to specify in such Order:

AND WHEREAS the United States of America are not a party to the said International Union for the protection of Literary and Artistic Works:

NOW I, JAMES McNEILL, Governor-General of the Irish Free State, on the advice of the Executive Council, and in exercise of the powers conferred on me by paragraph (a) of sub-section (2) of section 154 of the Industrial and Commercial Property (Protection) Act, 1927 (No. 16 of 1927), as amended by section 10 of the Industrial and Commercial Property (Protection) (Amendment) Act, 1929 , (No. 13 of 1929), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say:—

1. This Order may be cited for all purposes as the Copyright (Irish Translations) (United States of America) Order, 1929.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. All classes of works the authors of which were at the date of the making of such works citizens of the United States of America shall be and are hereby excluded from the operation of the first proviso to paragraph (a) of sub-section (2) of section 154 of the Industrial and Commercial Property (Protection) Act, 1927 (No. 16 of 1927), as amended by section 10 of the Industrial and Commercial Property (Protection) (Amendment) Act. 1929 (No. 13 of 1929).
