PIGS AND BACON ACT, 1935 BACON MARKETING BOARD (ORDINARY MEMBERS) ELECTION ORDER, 1936.

PIGS AND BACON ACT, 1935 BACON MARKETING BOARD (ORDINARY MEMBERS) ELECTION ORDER, 1936.

WHEREAS by virtue of the Pigs and Bacon Act, 1935 (Part III) (Commencement) Order, 1935 (Statutory Rules and Orders No. 262 of 1935), Part III of the Pigs and Bacon Act, 1935 (No. 24 of 1935), came into operation on the 6th day of August, 1935:

AND WHEREAS the provisions of the said Act hereinafter mentioned are contained in Part III thereof:

AND WHEREAS it is enacted by sub-section (1) of Section 76 of the said Act, that the Minister for Agriculture shall, in every election year as soon as may be after the qualifying date, do the following things, that is to say:—

(a) if there are any persons who were on such date large curers, prepare a panel (in Part III of the said Act referred to as a panel of large curers) of the names of such persons;

(b) if there are any persons who were on such date medium curers, prepare a panel (in Part III of the said Act referred to as a panel of medium curers) of the names of such persons;

(c) if there are any persons who were on such date small curers, prepare a panel (in Part III of the said Act referred to as a panel of small curers) of the names of such persons;

AND WHEREAS it is enacted by sub-section (3) of Section 77 of the said Act that if three panels are required under Section 76 of the said Act to be prepared in any election year, the Minister for Agriculture shall, as soon as may be after the preparation of such panels, make an order declaring that of the seven ordinary members—

(i) such number as may be specified in such order shall be elected by the persons whose names are entered in such one of the said panels as is a panel of large curers at a meeting of such persons to be held on the date in such election year specified in that behalf in such order;

(ii) such number as may be specified in such order shall be elected by the persons whose names are entered in such one of the said panels as is a panel of medium curers at a meeting of such persons to be held on the date in such election year specified in that behalf in such order; and

(iii) the remainder shall be elected by the persons whose names are entered in such one of the said panels as is a panel of small curers at a meeting of such persons to be held on the date in such election year specified in that behalf in such order:

AND WHEREAS the year 1936 is an election year within the meaning of Part III of the said Act and three panels were required under Section 76 of the said Act to be prepared in the year 1936, and the said three panels have been duly prepared by the Minister:

NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in pursuance of sub-section (3) of Section 77 of the Pigs and Bacon Act, 1935 (No. 24 of 1935), and in exercise of the powers conferred on me by the said sub-section and of every and any other power me in this behalf enabling, do hereby order as follows:—

1. This Order may be cited as the Bacon Marketing Board (Ordinary Members) Election Order, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. Of the seven ordinary members of the Bacon Marketing Board—

(a) two shall be elected by the persons whose names are entered in the panel of large curers (prepared in the year 1936) at a meeting of such persons which shall be held on the 24th day of November, 1936;

(b) three shall be elected by the persons whose names are entered in the panel of medium curers (prepared in the year 1936) at a meeting of such persons which shall be held on the 24th day of November, 1936;

(c) two shall be elected by the persons whose names are entered in the panel of small curers (prepared in the year 1936) at a meeting of such persons which shall be held on the 24th day of November, 1936.
