DUNDALK, NEWRY AND GREENORE RAILWAY (ABANDONMENT) WARRANT, 1953. |
||
WHEREAS on the 29th day of February, 1952, the Dundalk, Newry and Greenore Railway Company (hereinafter called " the Company ") duly applied to the Minister for Industry and Commerce (hereinafter called " the Minister ") pursuant to the Abandonment of Railways Act, 1850, for authority to abandon the whole of the railway in the County of Louth formerly operated by the Company and constructed pursuant to the Newry and Greenore Railway Act, 1863, the Dundalk and Greenore Railway Act, 1863. and the Dundalk, Newry and Greenore Railway Act, 1873 : |

AND WHEREAS, it appearing to the Minister that there were sufficient grounds for entertaining the application, the Minister required and directed the Company to publish notice of the making of the application in accordance with section 13 of the Abandonment of Railways Act, 1850 : |

AND WHEREAS the Minister is satisfied that such notice has been duly given and has considered all objections duly brought before him : |

AND WHEREAS the Company has entered into an Agreement (hereinafter called " the Agreement ") with the Minister dated the 21st day of December, 1953, whereby the Company agrees, in consideration of the grant of a Warrant of Abandoment of the said railway, to pay compensation as therein provided to owners and occupiers of adjoining lands in respect of injury and loss which may be suffered by them by reason of the Company's ceasing, after the grant of the said Warrant, to maintain certain accommodation works, embankments and other protective works : |

NOW I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred by the Abandonment of Railways Act, 1850, and of every other power enabling me in this behalf, do by this Warrant order as follows : |
||
1. This Warrant may be cited as the Dundalk, Newry and Greenore Railway (Abandonment) Warrant, 1953. |
||
2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Warrant. |
||
3. The Company is hereby authorised, subject to the provisions of the Agreement (compliance with which by the Company is a condition of this Warrant) to abandon the whole of the Railway now vested in the Company in the County of Louth. |
||
