INSURANCE (INTERMITTENT UNEMPLOYMENT) (EXTENSION) ORDER, 1955.

INSURANCE (INTERMITTENT UNEMPLOYMENT) (EXTENSION) ORDER, 1955.

I, BRENDAN CORISH, Minister for Social Welfare, in exercise of the powers conferred on me by the joint operation of section 15 of the Insurance (Intermittent Unemployment) Act, 1942 (No. 7 of 1942), and Article 4 of the Social Welfare (Transfer of Departmental Administration and Ministerial Functions) (No. 1) Order, 1947 ( S. R. & O. No. 18 of 1947 ), and of every and any other power me in this behalf enabling, and with the consent of the Minister for Finance, hereby order as follows :

1.--(1) This Order may be cited as the Insurance (Intermittent Unemployment) (Extension) Order, 1955.

(2) This Order shall come into operation on the thirtieth day of May, 1955.

2. In this Order--

" employment in the civil engineering trade " has the meaning assigned to it in the First Schedule to this Order ;

" employment in the painting trade " has the meaning assigned to it in the Second Schedule to this Order.

3. It is hereby declared that the following employments shall be insurable employments for the purposes of the Insurance (Intermittent Unemployment) Act, 1942 (No. 7 of 1942) :

(a) employment in the civil engineering trade, other than employment specified in the Third Schedule to this Order ;

(b) employment in the painting trade, other than employment specified in the Third Schedule to this Order.

4. The expression "skilled worker" is hereby defined in relation to the employments declared by this Order to be insurable employments as an insured person who is employed under a contract of service or apprenticeship in the capacity of carpenter, joiner, wood-cutting machinist, bricklayer, mason, stonecutter, stonelayer, terrazzo and mosaic worker, floor and wall tiler, plasterer, slater, roof-tiler, painter, paperhanger, decorator, glazier, plumber, heating-fitter, gas-fitter, french-polisher or electrician.

In accordance with Section 15 (2) of the Insurance (Intermittent Unemployment) Act, 1942 , this Order was placed before each House of the Oireachtas. The Resolution confirming the Order was passed by Dáil Éireann on the 18th May, 1955, and by Seanad Éireann on 25th May, 1955.

FIRST SCHEDULE.

" Employment in the civil engineering trade " means employment on work of a kind commonly undertaken or carried out by civil engineering or public works contractors and includes employment on work of the following descriptions, that is to say :

(a) the construction, reconstruction, alteration, repair, painting, decoration or demolition of--

(i) roads, paths, kerbs, bridges, viaducts, aqueducts, harbours, docks, wharves, piers, jetties, quays, promenades, landing places, lighthouses, beacons, sea defences, airports, railroads, tunnels, tramways or canals ;

(ii) waterworks, reservoirs, filter beds, wells, works for the production of gas or electricity, sewage works, public mains for the supply of water, gas or electricity or for the disposal of sewage and all work in the connection of buildings and their sites with such mains ;

(iii) river works, dams, weirs, embankments, breakwaters, moles, works for the purpose of land or road or river drainage, land reclamation or the prevention of coastal erosion ; and

(iv) sports-grounds, playgrounds, tennis courts, ball alleys, swimming pools and public baths or bathing places in concrete, stone, tarmacadam, asphalt or such like material ;

(b) the erection or laying, alteration, repair, painting, decoration or demolition of poles, masts, standards, pylons, wires or cables for telephone, telegraph or radio communication or for broadcasting; and

(c) ground levelling, ground formation or drainage in connection with the construction or reconstruction of grass sports-grounds, public parks, playing fields, tennis courts, golf links, playgrounds, racecourses and greyhound racing tracks, but excluding the sowing of grass seed on such grounds.

SECOND SCHEDULE.

" Employment in the painting trade " means employment on work of a kind commonly undertaken or carried out by painting contractors.

THIRD SCHEDULE.

Employment, other than employment in the building trade, of the following descriptions, that is to say :

(a) employment of unskilled workers and of young persons on (i) work undertaken for the development of bogs or (ii) work undertaken in the course of the establishment and maintenance of forests, and (iii) works financed wholly or mainly out of Funds administered by the Special Employment Schemes Office ;

(b) employment by a local or public authority ;

(c) employment by the State on work in the construction, reconstruction, maintenance, alteration, repair or demolition of public roads ;

(d) employment on works undertaken under the Arterial Drainage Act, 1945 , or under the Land Reclamation Act, 1949 , or any Acts for the time being in force replacing or amending those Acts ;

(e) employment by the Minister for Posts and Telegraphs on all work in the erection or laying, alteration, repair, painting, decoration or demolition of poles, masts, standards, pylons, wires or cables for telephone, telegraph or radio communication or for broadcasting ;

(f) employment by Córas Iompair Éireann or by Great Northern Railways (Ireland) where no deductions are made from the wages of employed persons on account of time lost owing to inclement weather ;

(g) employment by the Electricity Supply Board on work carried out directly by the Board in accordance with its statutory functions.

In this Schedule--

" unskilled workers " means workers exclusive of any worker who is employed under a contract of service or apprenticeship in the capacity of carpenter, joiner, wood-cutting machinist, bricklayer, mason, stonecutter, stonelayer, terrazzo and mosaic worker, floor and wall tiler, plasterer, slater, roof-tiler, painter, paperhanger, decorator, glazier, plumber, heating-fitter, gas-fitter, french-polisher or electrician ;

" young person " means a person who has attained the age of sixteen years but has not attained the age of twenty-one years, subject to the proviso that a person who attains the age of twenty-one years shall be regarded as a young person until the last day of the insurance year in which he attains that age.
