S.I. No. 177/1956:

FACTORIES (GENERAL REGISTER) REGULATIONS, 1956.

FACTORIES (GENERAL REGISTER) REGULATIONS, 1956.

I, WILLIAM NORTON, Minister for Industry and Commerce, in pursuance of section 122 of the Factories Act, 1955 (No. 10 of 1955), hereby make the following regulations :

1.--(1) These Regulations may be cited as the Factories (General Register) Regulations, 1956.

(2) These Regulations shall come into operation on the 1st day of October, 1956.

2. In these Regulations--

" the Act " means the Factories Act, 1955 (No. 10 of 1955) ;

" the Minister " means the Minister for Industry and Commerce,

3. The general register required by subsection (1) of section 122 of the act to be kept in every factory, or in such place outside the factory as may be approved by an inspector, shall be in the form set out in the Schedule to these Regulations.

4. The particulars as to every young person employed in a factory required by paragraph (a) of subsection (1) of section 122 of the act to be entered in or attached to the general register, shall be the following :

(a) christian name, surname and address ;

(b) date of birth ;

(c) date of first employment in the factory and date of leaving such employment ;

(d) certificate of fitness or unfitness for employment signed by the certifying doctor or other registered medical practitioner, as the case may be ;

(e) date of issue of certificate ;

(f) name and address of doctor, if not the certifying doctor ;

(g) any conditions attached to the certificate.

5. The particulars as to the washing, whitewashing or colour washing, painting or varnishing of a factory, required by paragraph (b) of subsection (1) of section 122 of the act to be entered in or attached to the general register, shall be the following :

(a) parts washed, whitewashed, colour washed, painted or varnished ;

(b) date work was done ;

(c) parts of the factory and surfaces for which exemption is claimed ;

(d) name and address of person by whom the work was done ;

(e) signature of the occupier of the factory or of his agent ;

(f) date of such signature.

6. The particulars as to every accident occurring in a factory, required by paragraph (c) of subsection (1) of section 122 of the act, to be entered in or attached to the general register, shall be the following :

(a) date and place of accident ;

(b) date notice of the accident on the appropriate form) was sent to the Minister ;

(c) cause of accident (whether caused by machinery in motion and by what part of such machinery) ;

(d) name, sex and age of person injured ;

(e) usual employment of such person ;

(f) precise occupation of such person at time of accident ;

(g) nature of injury and whether fatal or not ;

(h) period of disablement (if applicable).

7. The particulars of every case of industrial disease occurring in a factory of which notice is required to be sent to the Minister, required by paragraph (c) of subsection (1) of section 122 of the act to be entered in or attached to the general register, shall be the following :

(a) date notice of occurrence (on the appropriate form) was sent to the Minister and the certifying doctor ;

(b) name, sex and age of the person affected ;

(c) precise occupation of such person ;

(d) notifiable disease to which occurrence was due ;

(e) other remarks.

8. There shall be entered in and attached to the general register the following particulars of every dangerous occurrence in a factory (being an occurrence specified in the Schedule to the Factories Act, 1955 (Extension of Section 74 to Dangerous Occurrences) Regulations, 1956).

(a) date and place of occurrence ;

(b) date notice of the occurrence (on the appropriate form) was sent to the Minister ;

(c) cause of occurrence.

SCHEDULE.

GENERAL REGISTER.

Name of Occupier.

(In the case of a firm which is not a registered company, the name of each partner should be entered).

Outworkers

The occupier is required to keep (in Form F.I. 1016) a list of outworkers employed in certain specified classes of work. A copy of the list must be sent to the Sanitary Authority during the month of February and the month of August in each year.

Address of Factory.

(Include name of Sanitary Authority for district in which factory is situate).

Nature of work carried on.

Reports and Certificates required to be attached to the General Register.
