DEPARTMENT OF POSTS AND TELEGRAPHS. FOREIGN POST AMENDMENT (No. 6) WARRANT, 1959.

I, SÉAMAS Ó RIAIN, Minister for Finance, on the representation of the Minister for Posts and Telegraphs as testified by his official seal affixed hereto, and in exercise of the powers conferred on me by sections 2, 4, 12 and 82 of the Post Office Act, 1908, hereby order as follows :--

1.--(1) This Warrant may be cited as the Foreign Post Amendment (No. 6) Warrant, 1959.

(2) This Warrant shall come into operation on the first day of April, 1959.

2. The Intepretation Act, 1937 (No. 38 of 1937), applies to this Warrant.

3. In this Warrant " the Principal Warrant " means the Foreign Post Warrant, 1949 ( S.I. No. 267 of 1949 ).

4. This Warrant shall be construed as one with the Principal Warrant.

5. Paragraph (8) of Regulation 3 of the Principal Warrant is hereby amended by the insertion of " and also includes a packet transmitted at the letter rate of postage and containing goods or articles of merchandise " after " correspondence."

6. The following subparagraph is hereby substituted for subparagraph (i) of paragraph (10) of Regulation 3 of the Principal Warrant :

" (i) books or papers (including letters to or from blind persons) impressed or otherwise prepared for the use of the blind."

7. Paragraph (15) of Regulation 3 of the Principal Warrant is hereby amended by the insertion of " small packet," after " sample packet."

8. Paragraph (20) of Regulation 3 of the Principal Warrant is hereby amended by the deletion of " and pathological objects rendered harmless by their mode of preparation and packing."

9. The following paragraph is hereby inserted after paragraph (20) of Regulation 3 of the Principal Warrant :

Small packet.

" (20A). In this Warrant the expression " small packet " means a packet which consists of or contains goods or articles of merchandise and contains or bears nothing else except an open invoice reduced to its essential elements, any customs declaration required and the names and addresses of the sender and addressee."

10. The following Regulation is hereby inserted after Regulation 9 of the Principal Warrant :

Small packet.

" 9A. Except as otherwise provided in this Warrant, there shall be charged and paid on every small packet addressed to any country or place with which the Minister may for the time being have an arrangement for the transmission of small packets the rates of postage specified in respect thereof in the First Schedule hereto."

11. Subparagraph (a) of paragraph (4) of Regulation 15 of the Principal Warrant is hereby amended by the insertion of " small packets," after " printed packets."

12.--(1) Paragraph (2) of Regulation 21 of the Principal Warrant is hereby amended by the insertion of " small packet," after " sample packet,"

(2) Paragraph (3) of Regulation 21 of the Principal Warrant is hereby amended by the substitution of " sample packet or small packet " for " or sample packet."

13. The following Regulation is hereby substituted for Regulation 25 of the Principal Warrant :

SPECIAL CONDITIONS AS TO COMMERCIAL PACKETS, PRINTED PACKETS, SAMPLE PACKETS, SMALL PACKETS, MAGAZINES FOR CANADA AND PACKETS CONSISTING OF LITERATURE FOR THE BLIND.

Condition of posting.

" 25. Every commercial packet, printed packet, sample packet, small packet, magazine for Canada, and packet consisting of literature for the blind, shall be subject to examination in the post, and, subject to the provisions of this Warrant, shall not contain anything sealed or otherwise closed against inspection, or contain or bear anything in the nature of a current and personal correspondence."

14. Subclause (a) of clause (i) of the proviso to paragraph (1) of Regulation 27 of the Principal Warrant is hereby amended by the insertion of " telex exchange and number," after " telephone number,"

15. Paragraph (5) of Regulation 28 of the Principal Warrant is hereby amended by the insertion of " telex exchange and number," after " telephone number.,"

16. The following Regulation is hereby inserted after Regulation 28 of the Principal Warrant :

Rules as to small packets.

" 28A. (1) Every small packet shall bear on the outside the name and address of the sender and the addressee, and shall be clearly marked ` Small Packet ' on the left-hand side of the space above the address.

(2) The provisions in relation to the packing of sample packets contained in Regulation 28 shall (so far as applicable) apply to small packets."

17. Regulation 44 of the Principal Warrant is hereby amended by the addition thereto of the following paragraph :

" The advice of delivery form may, if the sender of the packet so requires, be transmitted by air mail to or from, or both to and from, the country or place of address of the packet ; and the sender shall pay for each transmission of the advice of delivery form by air mail the further fee specified in respect thereof in the Second Schedule hereto."

18. Paragraph (1) of Regulation 5 of the Foreign Post Amendment (No. 2) Warrant, 1953 ( S.I. No. 280 of 1953 ), is hereby amended by the insertion of " small packets," after " insured boxes,".

19. The entries in the First, Second and Third Schedules to this Warrant are hereby respectively substituted for the entries in the First, Second and Fourth Schedules, as amended, to the Principal Warrant.

20. The Foreign Post Amendment (No. 1) Warrant, 1951 ( S.I. No. 59 of 1951 ), and the Foreign Post Amendment (No. 3) Warrant, 1954 ( S.I. No. 67 of 1954 ), are hereby revoked.

SECOND SCHEDULE.

2. Customs Clearance Fee on incoming postal packet liable to Customs Duty.

3. Express postal packet--outgoing

A fee not exceeding 1s. as may be prescribed.

Express postal packet--incoming

At the scale of fees in force for express delivery of Inland postal packets.

4. Ordinary registration

A fee of 9d. per packet.

Late-Fee registration

A fee (in addition to the ordinary registration fee) not exceeding 6d. as may be prescribed.

5. Advice of delivery

A fee of 3d. per registered postal packet.

A further fee of 6d. for each air mail transmission of the advice of delivery form.

EXPLANATORY NOTE.

This Warrant comes into operation on the 1st April, 1959. It provides for changes in certain postal rates and fees, and for the introduction of a new category of mail (Small Packets) in the foreign post service. The present and new charges are as follows :--

The definitions of some categories of mail are amended, with the following effects :

(a) Letters : Green label packets sent at the letter rate containing goods or merchandise are included ;

(b) Literature for the Blind : Letters in braille (or otherwise specially prepared) sent to or by blind persons are included ;

(c) Sample : (i) pathological specimens are excluded ;

(ii) telex exchange and number of the sender may be indicated ;

(d) Printed paper : (i) packets containing one or more books may weigh up to 11 lb. (at present this limit applies to packets containing a single volume) ;

(ii) telex exchange and number of the sender may be indicated.

The provisions regarding minimum size of certain postal packets are relaxed.
