CENSORSHIP OF PUBLICATIONS (AMENDMENT) REGULATIONS, 1960. |

I, OSCAR TRAYNOR, Minister for Justice, in exercise of the powers conferred on me by section 20 of the Censorship of Publications Act, 1946 (No. 1 of 1946), hereby make the following regulations: |
||
1. (1) These Regulations may be cited as the Censorship of Publications (Amendment) Regulations, 1960. |
||
(2) The Censorship of Publications Act, 1946 , Regulations, 1946 and 1947, and these Regulations may be cited together as the Censorship of Publications Regulations, 1946 to 1960. |
||
(3) These Regulations shall come into operation on the 18th day of October, 1960. |
||
2. The Censorship of Publications Act, 1946 , Regulations, 1946 ( S.R. & O. No. 254 of 1946 ), are hereby amended by-- |
||
(a) the substitution of the following Regulations for Regulation 3 and 4, namely: |
||
"3. A complaint made under section 6 of the Act in respect of a book shall-- |
||
(a) be in writing. |
||
(b) state the reason why the complainant considers that the sale and distribution of the book in the State should be prohibited, |
||
(c) indicate the passages (if any) in the book upon which the complainant places particular reliance in support of his complaint, and |
||
(d) be accompanied by a copy of the book. |
||
4. A complaint made under section 9 of the Act in respect of a periodical publication shall-- |
||
(a) be in writing, |
||
(b) state the reason why the complainant considers that the sale and distribution in the State of the issues of the publication which are the subject of the complaint and of future issues of the publication should be prohibited, |
||
(c) indicate the passages (if any) in the issues of the publication accompanying the complaint upon which the complainant places particular reliance in support of his complaint, and |
||
(d) be accompanied by a copy of each of not less than three recent issues of the periodical publication." |
||
(b) the substitution in Regulation 11 of "A complaint or a form of prohibition order" for "A form of complaint or prohibition order", and |
||
(c) the deletion of forms A and B in the Schedule. |

EXPLANATORY NOTE. |
||
These Regulations alter the procedure for making complaints about books or periodical publications to the Censorship of Publications Board by abolishing the requirement that a prescribed form must be used. They do not alter the rule that the complaint must be in writing, that it must state the grounds on which it is made and that it must be accompanied by a copy of the book or--as the case may be--a copy of each of three recent issues of the periodical publication. |
