CORK TRAFFIC AND PARKING TEMPORARY RULES, 1970.

I, MICHAEL J. WYMES, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by sections 89 and 90 of the Road Traffic Act, 1961 (No. 24 of 1961) (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968)), and with the consent of the Minister for Local Government, hereby make the following temporary rules in respect of the area comprising the county borough of Cork:

Short title.

1. These rules may be cited as the Cork Traffic and Parking Temporary Rules, 1970.

Commencement.

2. These rules shall come into operation on the 16th day of March, 1970.

Interpretation.

3. In these rules--

"holiday" means any of the following days--

St. Patrick's Day or if that is a Sunday, the next day,

Good Friday,

Easter Monday,

the first Monday in June,

the first Monday in August,

Christmas Day or, if that is a Sunday, the 27th day of December,

St. Stephen's Day or, if that is a Sunday, the next day,

any day appointed under the Public Holidays Act, 1924 (No. 56 of 1924), to be a bank holiday in addition to or instead of one of the above seven days;

"vehicle" does not include a pedal cycle.

Area of application.

4. These rules shall apply to the area comprising the county borough of Cork.

Total prohibition on stopping or parking of vehicles.

5. (1) Subject to rule 6, the stopping or parking of a vehicle on a public road, on the same side of that road as a clearway sign to which an information plate is attached, is hereby prohibited during a period specified on that plate, except on a Saturday, Sunday or holiday.

(2) In this rule--

"clearway sign" means traffic sign 215 authorised by the Road Traffic (Signs) Regulations, 1962 (No. 171 of 1962), as amended by the Road Traffic (Signs) (Amendment) Regulations, 1966 (No. 233 of 1966);

"information plate" means a plate of the type authorised by paragraph 7 (inserted by the said Road Traffic (Signs) (Amendment) Regulations, 1966) of Part VI of the First Schedule to the said Road Traffic (Signs) Regulations, 1962.

Non-application of rule 5.

6. Rule 5 shall not apply to--

(a) a vehicle being used in connection with--

(i) the removal of obstruction to traffic,

(ii) the maintenance, improvement or reconstruction of a public road or part thereof, or

(iii) the provision, alteration or repair of a sewer, or of any main, pipe or apparatus for the supply of gas, water or electricity, or of a telegraphic or telephonic line;

(b) a fire engine, ambulance or Garda Síochána vehicle, being used in pursuance of statutory powers or duties;

(c) a vehicle stopped or parked because the stopping or parking is necessary in order to avoid an accident;

(d) an omnibus stopped at a stopping place or stand directed by notice under section 85 of the Road Traffic Act, 1961 (No. 24 of 1961);

(e) a small public service vehicle while merely picking up or setting down passengers;

(f) the stopping of a vehicle when the stopping is required under the Road Traffic Acts, 1961 and 1968, the Road Traffic General Bye-Laws, 1964 (No. 294 of 1964), or is caused by the exigencies of traffic.

EXPLANATORY NOTE.

1. Rule 5 prohibits the stopping or parking of a vehicle for any purpose from Mondays to Fridays inclusive (other than a holiday) during the hours specified on an information plate accompanying a clearway sign and applying to that side of the street, except in the case of an omnibus or a small public service vehicle which is actually engaged in picking up or setting down passengers.

2. These rules overrule the Cork Parking Temporary Rules, 1969 (No. 115 of 1969) during the periods of operation of these rules.
