DISTRICT COURT AREAS (VARIATION OF DAYS AND HOURS) (NO. 4) ORDER, 1973.

DISTRICT COURT AREAS (VARIATION OF DAYS AND HOURS) (NO. 4) ORDER, 1973.

I, PATRICK COONEY, Minister for Justice, in exercise of the powers conferred on me by section 26 (1) (f) of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Areas (Variation of Days and Hours) (No. 4) Order, 1973.

(2) This Order shall come into operation on the 1st day of December, 1973.

2. In this Order "the Principal Order" means the District Court Areas Order, 1961 ( S.I. No. 5 of 1961 ).

3. The days for holding the District Court in the district court area of Clifden shall, in lieu of the days specified in column (4) of the First Schedule to the Principal Order at reference number 83, and in column (4) of the Second Schedule to that Order at reference number 73, be the fourth Thursday in each month.

4. The days and hours for holding the District Court in the district court area of Galway shall, in lieu of the days and hours specified in column (4) of the First Schedule to the Principal Order at reference number 88, be the first, second, third and fourth Monday in each month at 10.30 a.m. and 2.30 p.m., and in lieu of the days and hours specified in column (4) of the Second Schedule to that order at reference number 77, be the third Thursday in each month at 10.30 a.m. and 2.30 p.m.

5. The days for holding the District Court in the district court area of Headford shall, in lieu of the days specified in column (4) of the First Schedule to the Principle Order at reference number 91, and in column (4) of the Second Schedule to that Order at reference number 80, be the second Thursday in each month.

6. The days and hours for holding the District Court in the district court area of Letterfrack shall, in lieu of the days and hours specified in column (4) of the First Schedule to the Principal Order at reference number 94, and in column (4) of the Second Schedule to that Order at reference number 82, be the fourth Friday in March, June, September and December at 12 noon.

7. The days for holding the District Court in the district court area of Kinvara shall, in lieu of the days specified in column (4) of the First Schedule to the Principal Order at reference number 93, and in column (4) of the Second Schedule to that Order at reference number 81, be the third Tuesday in January, March, May, July, September and November.

8. The days and hours for holding the District Court in the district court area of Maam shall, in lieu of the days and hours specified in column (4) of the First Schedule to the Principal Order at reference number 96, and in column (4) of the Second Schedule to that Order at reference number 84, be the third Wednesday in April, June, September and December at 3 p.m.

9. The days for holding the District Court in the district court area of Spiddal shall, in lieu of the days specified in column (4) of the First Schedule to the Principal Order at reference number 100, and in column (4) of the Second Schedule to that Order at reference number 88, be the first Thursday in each month.

10. Business transacted in any of the following District Court Areas, namely,

( a ) Clifden,

( b ) Galway,

( c ) Headford,

( d ) Kinvara,

( e ) Letterfrack,

( f ) Maam, or

( g ) Spiddal,

and which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business was initiated.

EXPLANATORY NOTE.

This Order alters the existing provisions with regard to the days and commencement times for holding sittings of the District Court in Galway, Letterfrack and Maam and the days for holding sittings of the District Court in Clifden, Headford, Kinvara and Spiddal.
