CASTLETOWNBERE FISHERY HARBOUR CENTRE (FISH AUCTION CHARGES) ORDER, 1974.

CASTLETOWNBERE FISHERY HARBOUR CENTRE (FISH AUCTION CHARGES) ORDER, 1974.

I, MICHAEL PAT MURPHY, Parliamentary Secretary to the Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 4 (2) (b) of the Fishery Harbour Centres Act, 1968 (No. 18 of 1968), and the Fisheries (Delegation of Ministerial Functions) Order, 1973 ( S.I. No. 93 of 1973 ), hereby order as follows:

1. This Order may be cited as the Castletownbere Fishery Harbour Centre (Fish Auction Charges) Order, 1974.

2. This Order shall come into operation on the 30th day of March, 1974.

3. ( a ) There shall be paid to the Minister by a person who sells fish at the hall provided by the Minister at Castletownbere Fishery Harbour Centre for the purpose of auctioning fish a toll of--

(i) 4p per cran, in the case of herrings, and

(ii) 4p per hundredweight, in the case of any other fish.

( b ) A toll under this Article in respect of any fish shall be retained by the person who auctions the fish out of the purchase price of the fish and shall be remitted by him to the Minister.

4. There shall be paid to the Minister by a person authorised to carry on auctions of fish at the hall aforesaid an annual charge of £50.

5. A toll or charge under this Order may be recovered by the Minister from a person who is required by this Order to remit or pay it to the Minister as a simple contract debt in any court of competent jurisdiction.

EXPLANATORY NOTE.

This Order fixes (1) tolls payable to the Minister by persons who sell fish in the Auction Hall in Castletownbere and (2) an annual charge payable to the Minister by any person authorised to carry on auctions of fish in the Auction Hall.

The Order specifies the manner in which the tolls shall be paid and remitted to the Minister and also the manner in which the tolls and charges may be recovered by the Minister from the persons who will be required by the Order to remit or pay them.
