MERCHANT SHIPPING (FEES) ORDER, 1981.

I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by section 5 of the Merchant Shipping (Amendment) Act, 1939 (No. 12 of 1939), section 5 of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952), as extended by section 3 of the Merchant Shipping Act, 1966 (No. 20 of 1966), section 4 of the Mercantile Marine Act, 1955 (No. 29 of 1955), section 26 of the Merchant Shipping (Load Lines) Act, 1968 (No. 17 of 1968), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and with the consent of the Minister for Finance hereby order as follows:

1. (1) This Order may be cited as the Merchant Shipping (Fees) Order, 1981.

(2) This Order shall come into operation on the 2nd day of February, 1981.

2. In this Order--

"tons" means gross tons, and the gross tonnage of a ship having alternative gross tonnages shall be taken to be the larger of those gross tonnages;

"the Regulations" means the Merchant Shipping (Tonnage) Regulations, 1967 ( S.I. No. 213 of 1967 ), and references in these Regulations to a Regulation are references to a Regulation of the Regulations;

"Part II tonnage" means the gross and register tonnages of a ship ascertained in accordance with Part II of the Regulations;

"modified tonnage" means the gross and register tonnages of a ship ascertained in accordance with Regulation 13;

"alternative tonnage" means the alternative gross and register tonnages of a ship ascertained in accordance with Regulation 14.

3. There shall, subject to and in accordance with the provisions of the Schedules to this Order, be charged and paid, in respect of each matter mentioned in any of those Schedules, the fee specified in that Schedule in respect of that matter.

4. The Merchant Shipping (Fees) Order, 1968 ( S.I. No. 185 of 1968 ), the Merchant Shipping (Load Lines) (Fees) Regulations, 1968 ( S.I. No. 257 of 1968 ), the Merchant Shipping (Fees) (Amendment) Order, 1969 ( S.I. No. 212 of 1969 ) and the Merchant Shipping (Fees) (Amendment) Order, 1971 ( S.I. No. 67 of 1971 ), are hereby revoked.

FIRST SCHEDULE.

PART I.

FEES PAYABLE IN CONNECTION WITH THE ISSUE OF CERTIFICATES AND SURVEYS OF SHIPS (OTHER THAN CERTIFICATES AND SURVEYS OF SHIPS MENTIONED IN PARTS II AND III TO THIS SCHEDULE) AND OTHER MERCANTILE MARINE SERVICES.

NOTES.

I. Except where otherwise stated, the appropriate fees must be paid before any survey, inspection (other than an inspection relating to a certificate mentioned in Article 1) or service can be undertaken. In cases where the fee cannot be assessed beforehand (e.g. tonnage measurements), a deposit sufficient to cover the probable charge is required and any outstanding expenses or balance of fees must be paid before the case is completed.

II. Fees and expenses under this Schedule, other than those mentioned in Articles 6, 7, 21, 22, 23, 24 and 25, must in every case be paid to the Superintendent of a Mercantile Marine Office and not to Surveyors.

III. An official receipt is given for all payments.

1. Fees for a general safety certificate or a qualified safety certiticate together with an exemption certificate for:--

NOTES.

I. The fees specified in paragraph (a) above must be paid in full in respect of a new ship or a ship coming under survey for the first time even though a certificate for twelve months may not be required. In other cases when a certificate for less than twelve months is required the fee shall be in proportion to the period from the date of termination of the survey to the date of expiration of the certificate at the rate of 1/12th of the full fee for each month or part of a month: Provided that the fee payable shall in no case be less than--

(i) in the case of a ship not exceeding 100 tons, 3/12th of a twelve months' fee or £88, or

(ii) in the case of a ship exceeding 100 tons, 3/12th of a twelve months' fee or £132

whichever is the greater.

II. In any case in which the duration of the certificate has been limited by the Surveyor's declaration owing to special reasons rendering one or more further surveys necessary within the ensuing twelve months the total fees paid for certificates covering the period of twelve consecutive months shall not exceed that payable for a twelve months' certificate.

III. The fees specified at paragraphs (a), (b) and (c) above--

(i) include the fees for the survey of the ship and are not returnable when the survey has been carried out, and the certificate cannot be issued due to a deficiency of the hull, equipment or machinery of the ship;

(ii) cover any number of visits which a Surveyor may require to make before granting his declaration and include the survey of the hull, boilers and propelling machinery (including tests of the materials), and the inspection of the equipment of the ship, including the lights and fog signals. The full fee under subparagraph (a) covers a survey for loadline if both surveys are made at the same time. It does not, however, include inspection of the crew spaces (Article 10 (c)), or measurement for tonnage (Article 6).

2. Fees for a safety equipment certificate or a qualified safety equipment certificate together with an exemption certificate.

Note: The fees mentioned in this Article are in addition to the fee for a safety equipment certificate, a qualified safety certificate and a qualified safety equipment certificate.

4. Fees for the inspection of life-saving appliances.

( a ) For the inspection on the application of the owner (not being an inspection made with a view to the issue of a passenger certificate or of any of the certificates referred to in sections 20 and 22 of the Merchant Shipping (Safety Convention) Act, 1952 ), under section 431 of the Merchant Shipping Act, 1894, as amended by section 13 of the Merchant Shipping (Safety Convention) Act, 1952 , of a ship other than a passenger steamer either during construction of the ship or otherwise for the purpose of seeing that the ship complies with the rules made under section 427 of the Merchant Shipping Act, 1894, as amended by section 11 of the Merchant Shipping (Safety Convention) Act, 1952 , and section 10 of the Merchant Shipping Act, 1966 .

Note: The fees mentioned in paragraphs (a) and (d) include the issue of a report of inspection. If the boats or buoyant apparatus are for a passenger ship or for a cargo ship requiring a safety equipment certificate the fees are in addition to the usual fees for a certificate.

5. Fees for inspection of radio installation.

( a ) For the inspection of a ship on the application of the owner (not being an inspection for the purpose of issuing a passenger certificate or a radio or a radio exemption certificate) for the purpose of seeing that she is properly provided with a radio installation and radio officers or radio-telephone operators--

(i) ships not exceeding 1,600 tons	41.40
(ii) ships exceeding 1,600 tons	81.40

( b ) For the inspection of a ship for such purposes, otherwise than on the application of the owner, if the ship is found not to be properly provided with a radio installation and radio officers or radio-telephone operators--

6. Fees for inspection for certificate of measurement and build.

( a ) Subject to paragraph (b) of this Article for measurement of Part II tonnage in the case of a ship--

	(i) in the case of a ship the Part II tonnage of which has been previously ascertained		One half the appropriate fee shown in paragraph (a) of this Article.
	(ii) in the case of a ship the Part II tonnage of which has not previously been ascertained, not being a case to which subparagraph (iii) of this paragraph applies		The appropriate fee shown in paragraph (a) of this Article plus one half.
	(iii) in the case of a ship with modified tonnage		The appropriate fee shown in paragraph (a) of this Article plus one half, less the fee which would be due if the ship were being measured as in paragraph (c) (ii) of this Article.
( e )	for the measurement of tonnage in a case to which Regulation 15 (remeasurement of tonnage of ships registered prior to the coming into operation of the Regulations) applies--maximum fee		The appropriate fee shown in paragraph (a), (c) or (d) of this Article as the case may require.
( f )	For remeasurement of tonnage in any case in which in consequence of alterations to the ship, remeasurement of the ship's under-deck tonnage is required ...		The appropriate fee shown in paragraph (a), (c) or (d) of this Article as the case may require.
( g )	For remeasurement of tonnage in any case (not being a case to which paragraph (f) of this Article applies) in which, in consequence of alterations to a ship, remeasurement of the tonnage of between deck space between the second deck and the upper deck of the ship is required		One half the appropriate fee shown in paragraph (a), (c) or(d) of this Article as the case may require.
( h )	Except in a case for which a fee is payable as above for remeasurement or remeasurement done at the same time, for remeasurement of tonnage due solely to an alteration of space comprised in one of the following categories of space:--
	(i) space on or above the upper deck;
	(ii) propelling machinery space below the upper deck;
	(iii) space described in Regulation 6 (1) (e);
	(iv) space described in Regulation 11 (a) to (i);
	(v) space in a double bottom for water ballast and space in water ballast tanks;
	a fee in respect of each category comprising space so measured as follows:--

Note: If a vessel previously measured as at paragraph (b) above, is remeasured as at paragraph (a) above, the full fee prescribed in paragraph (a) above shall be payable without any deduction.

7. Fees for survey for seaworthiness.

( a ) for the survey of a ship by direction of a Court under section 463 the Merchant Shipping Act, 1894--

(i)	by a Surveyor appointed by the Minister for Transport under section 724 of the Merchant Shipping Act, 1894--

Note: The fees mentioned in this paragraph do not include any other services.

( b ) for the survey of a ship finally detained or where it appears that a ship provisionally detained was at the time of that detention an unsafe ship--

(i) if detained because of overloading, improper loading, insufficient ventilation of coal cargoes, undermanning, or defective equipment, such as chronometers or charts, the fee payable shall be that prescribed in paragraph (a) (i) of this Article;

(ii) if the ship is detained because of defective hull or machinery the fee payable shall be that prescribed in paragraph (a) (ii) of this Article;

( c ) for the survey of a ship detained under Part II of the Merchant Shipping (Safety and Load Line Conventions) Act, 1933 (No. 12 of 1933)--

(i) for the submersion of the appropriate load line, the fee payable shall be that prescribed in paragraph (a) (i) of this Article;

(ii) for being unmarked or being improperly marked with load lines or for failure to deliver up an expired Load Line Certificate--

( d ) for survey before transfer to a foreign flag, the fees payable shall be those set out in paragraph (a) (ii) of this Article.

8. Survey for seaworthiness, prior to re-registry, of a ship whose registry has been closed on account of wreck, etc.

The fee payable work shall be determined in accordance with the amount of work involved.

9. Fees for the inspection of plans

( a ) Designs of hulls of proposed ships

(i)	examination of structural drawings and scantlings	60.60
(ii)	consideration of watertight subdivision arrangements	60.60
(iii)	consideration of fire protection arrangements	60.60

Note: The fees mentioned in this paragraph which relate to the examination of preliminary plans, are additional to any fees which may later become chargeable for other services.

( b ) Designs of boilers, machinery, etc.

10. Fees for Miscellaneous surveys and inspections.

( a ) Survey of marine boilers prior to issue of general safety certificate under the Merchant Shipping Act, 1894--

For one new double-ended cylindrical boiler	88.00
For one single-ended cylindrical boiler or one water tube boiler	82.00
This fee covers the inspection of the drawings and the survey of the boiler or boilers up to and including the hydraulic test, but no declaration or certificate can be issued until either the fee for a passenger certificate or a fee of £32 for a certificate of inspection has been paid. If the ship for which the boilers are intended is ultimately surveyed for a passenger certificate before the boilers have been in use these fees shall be considered as a portion of the survey fee for such certificate and credit shall be given for them accordingly.

( b ) Survey of ships in dry dock prior to issue of general safety certificate under the Merchant Shipping Act, 1894--

(i)	For the survey in dry dock of the hull of a ship holding a passenger certificate issued by the Minister for Transport or recognised by him, unless the survey is made during a complete survey of the whole ship and for the issue of a dry docking certificate--
	ships not exceeding 10,000 tons	44.00
	ships exceeding 10,000 tons	60.60
(ii)	For the survey in dry dock of any other ship, a quarter of the appropriate fee mentioned in Article I (a) plus £11.00 for each propeller drawn.
	For a copy of dry-docking certificate	5.00

( c ) Inspection of crew spaces--

For each visit to the ship	21.00
Maximum fee irrespective of the number of visits	88.00
If the inspection of crew spaces is made at the same time as the survey for tonnage measurement, or the survey prior to registry or re-registry, or if the Minister is satisfied that the inspection was made in consequence of an unjustified complaint, no separate fee is chargeable (See Articles 6 and 8).

( d ) Fees for inspection and approval of lights and fog signals.

For the inspection of lights and fog signals on any ship (including issue of Surveyor's report of inspection):
For each visit made to the ship on the application of the owner or for each visit made where the equipment is found defective	22.00
Maximum fee irrespective of the number of visits	88.00
For certified copy of the report	5.00
Should the inspection of lights and fog signals be carried out in conjunction with the surveys for passenger certificate or safety equipment certificate (Article 2) or measurement for tonnage (Article 6) or re-registry (Article 8), the fees specified for those services cover the inspection of lights and fog signals. Where the inspection of lights and fog signals is carried out as a separate service the fees specified above shall be payable.

( e ) Inspection of explosives magazines

(i)	inspection of fixed explosive magazine	21.60
(ii)	inspection of portable magazine at the same time as a fixed magazine, per magazine	3.60
(iii)	inspection of portable magazine where inspection of a fixed magazine is not involved	21.60
(iv)	attendance of Surveyor at pre-stowage conference on the stowage of explosives	21.60

11. Surveyors fees:

( a ) Surveyors' Expenses:

Except where otherwise stated and apart from overtime fees referred to in paragraphs (c) and (d) of this Article, no separate fees are payable for Surveyors' expenses or subsistence in the State or in Northern Ireland in addition to the fees set out in the preceding paragraphs except--

(i) where a Surveyor is called to a survey or inspection by the owner and is prepared to carry it out but is prevented from doing so by circumstances which it was within the power of the owner, his servants or agents to prevent

(ii) where a Surveyor is called upon to carry out a partial survey away from a normal survey centre for the purpose of the issue of a short-term certificate.

( b ) Surveys abroad:

The relevant survey fees together with a fee equivalent in amount to the Surveyors' travelling and subsistence expenses.

All fees and a deposit to cover the travelling and subsistence expenses must be paid in advance in the case of surveys abroad and an undertaking given for the payment of any balance of fees and expenses connected with the service.

( c ) Overtime fees:

For inspections in connection with the illumination from a ship of lifeboats in the process of and after launching and for tests of lifeboat searchlights, one-half the fees specified in this subparagraph.

Periods of less than one hour will be charged as one hour according to the scale.

For periods exceeding one hour, one-quarter fee will be charged for each quarter or part quarter of an hour, according to the scale. The maximum fee in any one case shall be limited to that for 10 hours.

Application for services by Surveyors out of office hours should be made on the prescribed form. The application must include an undertaking to pay the overtime fees.

The fees cover the services of all Surveyors.

Where the service cannot be commenced at the hour stated in the application or cannot be completed without interruption or if there is delay after completion, the time during which the Surveyors are kept waiting shall be charged at half the full appropriate overtime rate subject to a maximum fee of £194. Time occupied in travelling will not be deemed overtime except time spent on a tender between the shore and the ship which will be charged at half the full overtime rates.

( a ) Medical Inspection under section 306 of the Merchant Shipping Act, 1894.

Services by medical inspectors out of office hours--

Overtime fees in accordance with the following scale shall be charged in addition to those specified in paragraph (c) of this Article.

When attendance is required before 9 a.m. and after 5 p.m. on the same day the overtime fee will be payable in respect of each period.

These charges cover the whole of the inspection time occupied by the medical inspection.

Where three clear days' notice has been given of the survey or inspection and official arrangements have not allowed of the service being done within office hours, i.e. 9 a.m. to 5 p.m., no overtime charge will be made.

12. Fees for services by the staff of Mercantile Marine Offices.

Fees for engagement and discharge of seamen.

(a) For the engagement or discharge of seamen (other than members of the crews of fishing boats) before a Superintendent or his duly appointed deputy--
For each of the first 100 men		2.50
For each man in excess of 100		1.60
(b) Additional fees for the engagement and discharge of seamen on board ship
	For the engagement or discharge of seamen (other than members of the crews of fishing boats), the fees specified in this paragraph shall be charged in addition to those specified in paragraph (a) of this Article and the minimum fee for any visit of a Superintendent to a ship for the purpose of the engagement or discharge of such seamen shall be	19.20
	For each of the first 36 men engaged or discharged	1.20
	If more than 36 men but not more than 100 men are engaged or discharged	43.00
	For every 50 or fraction of 50 men in excess of 100 engaged or discharged	11.60
	If any seamen are engaged on board a ship £p immediately after their discharge on board that ship the additional fee payable by reason of their engagement on board ship shall be half that specified at paragraph (b) of this Article.	£ p
	The actual travelling expenses of the Superintendent and his assistants between the Mercantile Marine Office and the ship shall be charged in addition in every case.

For a service occupying less than an hour the charge shall be as for one hour according to the scale.

For a service occupying more than one hour but not an exact number of hours--

For each period of 30 minutes or less in excess of the exact number of hours, half the appropriate fee for 1 hour, the maximum charge in any one case to be limited to that for 10 hours.

If from unforeseen circumstances the service cannot be commenced at the time stated on the form of application or cannot be completed without interruption, the time during which the officers remain idle shall be charged for at half the appropriate overtime rate subject to a limit of 10 hours.

( f ) Waiting time during office hours--

Where the engagement or discharge of a crew takes place on board ship during office hours but does not commence at the time stated on the form of application the following charges for waiting time shall be payable--

For the first complete half hour and every half hour or part half hour thereafter

If a candidate for any certificate of competency fails in the sight tests only, the fee of £2.40 for examination in the sight tests will be deducted and the balance of the fee returned. If a candidate fails in any other part of the examination no part of the fee shall be returned.

A candidate for a certificate of competency as Master, Mate, Engineer, Skipper or Second Hand or any person enquiring as to his eligibility for examination, must pay the appropriate fee before any enquiry is made as to his qualifications.

Notes.

A. The fees under this paragraph shall not be charged to Government Departments or to Consuls or other representatives of foreign Governments when the inspection, etc., is required for official purposes.

The agreement and official log book of a ship for one voyage, or in case of running agreements (Home or Foreign Trade) for one half year, are to be regarded as constituting one record.

When certificates are lost by shipwreck or fire at sea, renewals or copies shall be issued without fee.

B. This fee is for the attendance of an officer for one day only. An additional charge of £1.90 a day shall be made for each document produced.

If an officer attends to produce documents at the hearing of two or more separate cases in the same Court on the same day, only one attendance fee shall be charged if the solicitor requiring the attendance is the same in all the cases. If different solicitors are concerned the full attendance fee shall be charged for each case. In either event the fee of £1.90 a day for each document produced shall be charged.

C. No charge shall be made for a Seaman's Record Book and Certificates of Discharge (Dis. A) when the original has been lost through shipwreck or fire at sea or for a continuation book when the original has been filled.

Part II.

LOAD LINES SURVEY FEES.

19. In this Part--

"the Act" means the Merchant Shipping (Load Lines) Act, 1968 (No. 17 of 1968);

"the Act of 1933" means the Merchant Shipping (Safety and Load Line Conventions) Act, 1933 (No. 42 of 1933);

"Assigning Authority" means a body which is an Assigning Authority for the purpose of the load line rules for the time being in force under the Act;

"a classed ship" means a ship which has been surveyed by or on behalf of an Assigning Authority ( other than the Minister) and has, following such survey, been classified by that authority in accordance with standards set for ships by it and remains so classified at the date of the survey or inspection for which a fee is payable in this Part;

"unclassed ship" means a ship which is not a classed ship;

20. The fee payable in respect of--

( a ) the survey of a ship carried out pursuant to the Merchant Shipping (Load Line) Rules, 1968 ( S.I. No. 205 of 1968 ), with a view to the issue of a load line certificate or a load line exemption certificate, and

( b ) the periodical inspection pursuant to the said rules of a ship for which such a certificate is in force,

shall, subject to Article 23, be the appropriate fee specified in the table of such fees in this Part.

21. The fee payable in respect of the inspection of a ship with a view to the issue of a load line certificate under Regulation 5 of the Merchant Shipping (Load Lines) (Transitional Provisions) Regulations, 1968 ( S.I. No. 207 of 1968 ), shall be the same as that for a periodical inspection mentioned in Article 20 (b) of this Part.

22. The fee in the case of a survey mentioned in Article 20 (a) of this Part or an inspection mentioned in Article 21 of this Part shall cover the issue of a load line certificate or a load line exemption certificate following the survey or inspection, as the case may be, and in the case of a periodical inspection mentioned in Article 20 (b) of this Part shall cover the endorsement of a certificate following the inspection.

23. The fees mentioned in the foregoing Articles of this Part and the payment thereof shall be subject to the provisions of Articles 24, 25, 26, 27, 28, 29, 30 and 31 of this Part and accordingly such fees shall be adjusted or be not payable in appropriate circumstances.

ADJUSTMENT OF FEES.

A. SURVEYS.

Periodical surveys of ships which have previously held certificates.

24. (1) In the case of a periodical survey of a classed ship the fee shall, except in a case to which subparagraph (2) of this paragraph applies, be reduced by one half.

(2) Where the periodical survey of a classed ship is carried out by a surveyor on behalf of an Assigning Authority other than the Minister at the same time as a special survey of the ship for classification purposes for which a fee is charged by that Authority, the fee payable in respect of the periodical survey shall be that which would be appropriate for a periodical inspection of the ship.

(3) In this paragraph "periodical survey" means a survey of a ship in respect of which there is in force at the time of the survey, or was in force immediately before that time, a load line certificate or a load line exemption certificate issued by or on behalf of the Minister under the Act or the Act of 1933.

Survey carried out concurrently with other surveys.

25. (1) Where a survey mentioned in Article 20 of a ship is carried out by a Surveyor appointed by the Minister concurrently with--

( a ) a survey of the ship for a Passenger Steamer Certificate or a Passenger and Safety Certificate--

(i) in the case of a classed ship, no fee shall be payable,

(ii) in the case of an unclassed ship, the fee payable shall be one half that which would otherwise be payable;

( b ) a survey of the ship (whether classed or unclassed) for the issue of a Cargo Ship Safety Construction Certificate, the fee payable shall be one half that which would otherwise be payable.

(2) No additional fee shall be payable under Articles 28 and 29 in any case to which subparagraph (1) (a) of this paragraph applies.

Survey where alterations do not necessitate a complete survey.

26. Where, in the case of a survey of a ship (whether classed or unclassed) in respect of which a load line certificate under the Act of 1933 or under the Act, or a load line exemption certificate is in force, alterations have been made to the ship which involves the assignment of new freeboards but are not such as to necessitate a complete survey of the ship for that purpose, the fee, where necessary, shall be that which would be appropriate for a periodical inspection of the ship, and the ship shall for the purposes of this paragraph be deemed to be a classed ship.

Partial survey carried out afloat for issue of short-term certificates.

27. Where a survey other than a complete survey is carried out on a ship afloat (whether classed or unclassed) for the purpose of the issue in respect of the ship of a load line certificate or a load line exemption certificate valid for a period not exceeding twelve months, the fee payable shall be one half of that which would otherwise be payable.

Additional fee where survey involves inquiry into stability.

28. (1) In the case of a survey mentioned in Article 20 of a ship which is required to comply with the requirements of the Fourth Schedule to the Merchant Shipping (Load Line) Rules, 1968, relating to stability, there shall, subject to Article 25(2) and subparagraph (2) of this paragraph, be paid an additional fee of £240 plus £4 for every metre, if any, by which the length of the ship exceeds 24 metres subject to a maximum additional fee of £1,600

(2) No additional fee shall be payable under this paragraph if--

( a ) the ship has been previously surveyed under the said Rules and was at the time of that survey required to comply with the above-mentioned requirements relating to stability, and

( b ) no changes have been made in the ship since that survey which necessitate an examination to ascertain whether the ship continues to comply with those requirements.

Additional fee where survey involves calculations relating to floodability.

29. Where in the case of a ship of more than 100 metres in length a survey involves calculations for the purposes of the Fifth Schedule to the Merchant Shipping (Load Line) Rules, 1968, as to the ability of the ship to withstand the flooding of compartments, subject to Article 25 (2) there shall be paid an additional fee of £600.

B. PERIODICAL INSPECTIONS.

Additional fees for periodical inspections.

30. (1) Where a periodical inspection mentioned in Article 20 of a ship of over 300 tons (whether classed or unclassed) is completed in one operation but requires two or more visits to the ship by the Surveyor, there shall be paid an additional fee of £44.

(2) Where such a periodical inspection of a ship (whether classed or unclassed) is not completed in one operation there shall be paid--

( a ) an additional fee of £44 for each part of the inspection, and

( b ) if the ship is over 300 tons and any part of the inspection requires two or more visits to the ship by the Surveyor, a further additional fee of £44 in respect of each such part.

(3) Such a periodical inspection shall be taken for the purposes of this paragraph to be completed in one operation if it is completed within one day, or within a period of successive days (excluding Sundays or public holidays) on each of which one or more visits to the ship are paid by the Surveyor.

(4) Where for the purposes of such an inspection it is necessary for the Surveyor to revisit the ship for the sole purpose of checking the rectification of defects found at an earlier stage of the inspection and on that visit those defects are found to be rectified, such visit shall not be taken into account for the purposes of this paragraph.

(5) Where such a periodical inspection of a ship is not completed in one operation but the fact that it is not so completed is in no way attributable to failure by the owner to have the ship available for inspection at any time after the commencement of the inspection, subparagraph (2) of this paragraph shall not apply in relation to the inspection.

Remission of fee where periodical inspection carried out concurrently with certain surveys--

31. Where a periodical inspection mentioned in Article 30 (1) of a ship is carried out by a Surveyor appointed by the Minister at the same time as--

( a ) a survey of the ship for the issue of a Passenger Steamer Certificate or a Passenger and Safety Certificate, or

( b ) any intermediate survey of the ship required under the cargo ship construction and survey rules made under the Merchant Shipping Act, 1966 (No. 20 of 1966),

no fee shall be payable in respect of the inspection.

PART III.

CARGO SHIP SURVEY FEES.

32. In this Part--

"certifying authority" means the Minister or other person authorised by the Minister to issue a cargo ship safety construction certificate;

"surveyor of ships" means a surveyor appointed by a certifying authority.

33. Subject to Articles 33, 34, 35 and 36 fees in accordance with the following Table of Fees shall be paid for surveys carried out in accordance with the Merchant Shipping (Cargo Ship Construction and Survey) Rules, 1967.

34. Where a Surveyor appointed by a certifying authority other than the Minister carries out concurrently with a survey for classification purposes a survey before the issue or renewal of a Cargo Ship Safety Construction Certificate or an intermediate survey no fees shall be payable under the preceding paragraph.

35. Where a surveyor of ships carries out a survey before the issue of a Cargo Ship Safety Construction Certificate on a ship the keel of which was laid before the 14th May, 1967, the fee payable on such survey shall be four times the amount shown in column (3) of the Table of Fees in Article 33.

36. Where a Surveyor of ships carries out a survey before the renewal of a Cargo Ship Safety Construction Certificate or an intermediate survey and such a survey is not completed in one operation but is effected by two or more partial surveys there shall be paid, in addition to the fees payable under column (3) or column (4), as the case may be, of the Table of Fees in Article 33:--

( a ) a fee of £80 for every partial survey, and

( b ) a further fee of £80 for every additional visit when more than one visit is paid to the ship by the surveyor for the purposes of such a partial survey.

37. Where a surveyor of ships carries out a survey of a ship for the issue in respect of a ship of a Cargo Ship Safety Construction Certificate which it is intended shall remain in force for a period not exceeding three months, and the ship is one in respect of which there is, or within the period of twelve months immediately preceding the survey there has been, in force a passenger certificate, the fee payable for such survey shall be as follows:

( a ) if the survey is carried out before or within one month after the expiry of the certificate--£100; and

( b ) if the survey is carried out more than one month but within twelve months after the expiry of the certificate--£200.

SECOND SCHEDULE.

FEES FOR REGISTRATION, TRANSFER AND MORTGAGE OF SHIPS.

Notes.

I. Fees under this Schedule are payable to Registrars of Ships.

II. Vessels belonging to the Commissioners of Irish Lights and vessels solely employed in fishing are exempt from the fees mentioned in this Schedule.

THIRD SCHEDULE.

FEES OF RECEIVERS OF WRECK.

Note.

Fees under this Schedule must be paid to the appropriate Receiver of Wreck.

1. For every report required to be sent by a Receiver of Wreck to the Secretary of Lloyd's in London the fee payable shall be £1.50.

2. For wreck taken into his custody by a Receiver of Wreck the fee payable shall be five per cent of the value of the wreck: Provided that in no case shall the amount so payable exceed £65.

3. In cases in which any services are rendered by a Receiver of Wreck in respect of any ship in distress, not being a wreck, or in respect of the cargo or articles belonging to the ship, the following fees shall be payable:

( a ) if the ship with her cargo equals or exceeds £1,200 in value, a fee of £16 for the first, and £8 for every subsequent day during which the Receiver is employed in that service; and

( b ) if the ship with her cargo is less in value than £1,200, one half of the amounts mentioned in paragraph (a) of this Article.

4. In addition to the fees mentioned in the foregoing Articles of this Schedule the expenses incurred in a particular case by a Receiver of Wreck shall be payable.
