AQUACULTURE (BLACKSOD AND BROADHAVEN BAYS) ORDER, 1985.

I, PADDY O'TOOLE, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 ) ), having complied with the requirements of subsection 3 (a) of the said section 54 and having considered a report made to me under subsection (4) of the said section 54 and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby, with the consent of the Minister for Communications, order as follows:--

1. (1) This Order may be cited as the Aquaculture (Blacksod and Broadhaven Bays) Order, 1985.

(2) The area described in the Schedule hereto is hereby designated to be an area within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980 ).

SCHEDULE.

All that area of Blacksod and Broadhaven Bays and adjoining waters which is bordered by the high-water mark and which lies north of a line drawn due west from the most westerly point of the high-water mark of the townland of Roy, barony of Erris, county of Mayo, and terminating at the high-water mark of the townland of Termon, barony of Erris, county of Mayo and which lies south of a line drawn due west from the most westerly point of the high-water mark of the townland of Kilgalligan, barony of Erris, county of Mayo, and terminating at the high-water mark of the townland of Glenlara, barony of Erris, county of Mayo.

EXPLANATORY NOTE.

This Order designates a specified area of Blacksod and Broadhaven Bays, County Mayo within which it shall be lawful to engage in aquaculture pursuant to a licence issued by the Minister for Fisheries and Forestry under section 54 of the Fisheries Act, 1980 .
