INLAND POST AMENDMENT (NO. 35) SCHEME, 1986. |

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), hereby makes the following Scheme: |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
1. (i) This Scheme may be cited as the Inland Post Amendment (No. 35) Scheme, 1986. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(ii) This Scheme shall be operative with effect from the 1st day of March, 1986. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
2. In this Scheme "the Principal Warrant" means the Inland Post Warrant, 1939 ( S. R. & O. No. 202 of 1939 ). |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
3. This Scheme applies to printed packets, newspapers and sample packets, within (in each case) the meaning of the Principal Warrant which are unaddressed and to which, by virtue of an arrangement between An Post and the sender thereof, this Scheme applies, and the service provided hereunder shall be known as the "Publicity Post Service" and is referred to as such in this Scheme. |

4. Regulations 9 and 10 of the Principal Warrant shall not apply to postal packets conveyed under the Publicity Post Service. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
5. Postage in accordance with this Scheme shall be payable in advance to an officer of An Post in Accordance with the arrangement pursuant to Regulation 3 of this Scheme between An Post and the sender. |

6. (1) Regulation 5 (1) of the Principal Warrant shall, in relation to postal packets conveyed under the Publicity Post Service, he construed and have effect as if the references therein to the rates of postage and to the limits of size and weight and to the conditions specified in columns 2 to 5 of the First Schedule to the Principal Warrant were a reference to the rates of postage, limits of size and weight and conditions specified in the Schedule to this Scheme. |

(2) In column 3 of the Schedule to this Scheme part (a) shall apply to postal packets each of which has a gross weight of not more than 20 grammes, and part (b) shall apply to postal packets each of which has a gross weight of more than 20 grammes but not more than 40 grammes, and no such postal packet shall exceed a gross weight of 40 grammes. |

7. Regulation 7 of the Principal Warrant shall not apply to any postal packet consisting of or containing two or more postal packets (of the same or of different descriptions) addressed to different persons who are at different addresses sent by a person to an officer of An Post or to an other person who will send it directly or indirectly to an officer of An Post, provided that in every such case: |

(i) the sender has made an arrangement pursuant to Regulation 3 of this Scheme or seeks to make such an arrangement; and |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(ii) none of the postal packets therein contained may be removed before reaching such officer of An Post without the consent of An Post. |

8. (1) Notwithstanding any provision to the contrary in the Principal Warrant, every postal packet to which this Scheme applies may be posted in the Publicity Post Service either with no cover or with such cover as may be agreed under the relevant arrangement pursuant to Regulation 3 of this Scheme and in concluding any such arrangement An Post may attach such conditions (other than as to rates of postage, but including conditions as to whether any such postal packet may be subject to examination in the post) as it sees fit. |

(2) Regulations 15 (a) to 15 (e) and 15 (g), 17 (1), 17 (2), 17 (4) and 18 (b) of the Principal Warrant shall not apply to postal packets to which this Scheme applies. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
9. The name and address of the sender of any postal packet to which this Scheme applies shall be printed or conspicuously stamped or written on such postal packet. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
10. No postal packet to which this Scheme applies shall be posted or delivered to any place outside the State. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
11. An Post may, in its own interest and at its discretion, suspend, withhold or restrict the Publicity Post Service so, however, that no person who has entered into an arrangement with An Post in accordance with Regulation 3 of this Scheme shall be thereby materially prejudiced. |
||||||||||||||||||||||||||||||||||||||||||||||||||||||||
12. Neither the conclusion of an arrangement pursuant to Regulation 3 of this Scheme nor any document evidencing such an arrangement or issued in accordance therewith shall render An Post or any officer of An Post liable for the loss of or damage to any postal packet or the contents thereof. |

13. No postal packet may be posted in the Publicity Post Service if it (or any matter contained in it) constitutes a "communication" within the meaning of the Presidential Elections Free Postage Regulations, 1959, the Seanad Elections (University Members) Free Postage Regulations, 1961 ( S.I. No. 194 of 1961 ), the Dáil Elections Free Postage Regulations, 1961 ( S.I. No. 195 of 1961 ), or the European Assembly Elections Free Postage Regulations, |
