S.I. No. 338/1989:

LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) (FEES) (AMENDMENT) REGULATIONS, 1989.

LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) (FEES) (AMENDMENT) REGULATIONS, 1989.

The Minister for the Environment, in exercise of the powers conferred on him by section 10 of the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963) and by section 10 of the Local Government (Planning and Development) Act, 1982 (No. 21 of 1982), and with the consent of the Minister for Finance, hereby makes the following Regulations:--

Citation.

1. (1) These Regulations may be cited as the Local Government (Planning and Development) (Fees) (Amendment) Regulations, 1989.

(2) These Regulations and the Local Government (Planning and Development) Regulations, 1977 to 1987 may be cited together as the Local Government (Planning and Development) Regulations, 1977 to 1989.

Commencement.

2. These Regulations shall come into operation on the 1st day of February, 1990.

Interpretation.

3. In these Regulations, "the 1984 Regulations" means the Local Government (Planning and Development) (Fees) Regulations, 1984 ( S.I. No. 358 of 1984 ).

Amendment of article 3 of 1984 Regulations.

4. Sub-article (6) of article 3 of the 1984 Regulations is hereby amended by the insertion after the definition of "the Board" of the following definition:

" 'commercial development' means development for the purposes of any professional, commercial or industrial undertaking, development in connection with the provision for reward of services to persons or undertakings, or development consisting of the provision of two or more dwellings, but does not include development for the purposes of agriculture;".

Amendment of article 19 of 1984 Regulations.

5. Sub-article (2) of article 19 of the 1984 Regulations is hereby amended by the insertion of the word "appropriate" before the word "mention".

Substitution of Third Schedule of 1984 Regulations.

6. The 1984 Regulations are hereby amended by the substitution for the Third Schedule thereof of the Schedule set out in the Schedule to these Regulations.

EXPLANATORY NOTE.

These Regulations revise, with effect from 1 February, 1990, the fees payable to An Bord Pleanala in respect of appeals, references and related matters.
