COMPANIES ACT, 1990 (COMMENCEMENT) (NO. 2) ORDER, 1991.

I, DESMOND O'MALLEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by sections 2 and 205 of the Companies Act, 1990 (No. 33 of 1990), hereby order as follows:

1. This Order may be cited as the Companies Act, 1990 (Commencement) (No. 2) Order, 1991.

2. In this Order "the Act" means the Companies Act, 1990 (No. 33 of 1990).

3. (1) The 1st day of July, 1991 is hereby fixed as the day on which the provisions specified in column (2) of Part I of the Table to this Order of the Parts of the Act specified in column (1) of the said Table shall come into operation.

(2) The 2nd day of July, 1991, is hereby specified for the purposes of section 205 of the Act.

(3) The 1st day of August, 1991 hereby fixed as the day on which the following provisions of the Act shall come into operation:

(a) the provisions specified in column (2) of Part II of the Table to this Order of the Parts of the Act specified in column (1) of the said Table, and

(b) the Schedule.

EXPLANATORY NOTE.

This Order fixes the 1st day of July, 1991 as the day on which Part XI, and certain provisions of Parts I to III, X and XII of the Companies Act, 1990 shall come into operation. The Order also fixes the 1st day of August, 1991 as the day on which Parts IV, VI, VII and VIII, and certain provisions of Parts I, IX and XII of the Act shall come into operation. Finally, the Order also specifies the 2nd day of July, 1991 for the purposes of section 205 of the Act.

The following table indicates the provisions of the Act which were brought into force by virtue of previous Commencement Orders under the Act, as well as the provisions which are the subject of the present Order.
