TELECOMMUNICATIONS (MISCELLANEOUS PROVISIONS) ACT, 1996 (COMMENCEMENT) (NO. 3) ORDER, 1997

I, ALAN DUKES, TD, Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 17 (2) of the Telecommunications (Miscellaneous Provisions) Act, 1996 (No. 34 of 1996), hereby make the following Order:

1. This Order may be cited as the Telecommunications (Miscellaneous Provisions) Act, 1996 (Commencement) (No. 3) Order, 1997.

2. In this Order, "the Act" means the Telecommunications (Miscellaneous Provisions) Act, 1996 (No. 34 of 1996).

3. The 30th day of June, 1997, is hereby appointed as the day on which sections 3, 4, 5, 6, 12, 13 (1) (paragraphs (a), (d) and (e)) and (4), 14 (1) (in respect of the provisions of the Wireless Telegraphy Act, 1926 , mentioned in column (3) of Part I of the Third Schedule to the Act) of the Act shall come into operation.

EXPLANATORY NOTE.

This Order brings into operation on 30 June, 1997 certain provisions of the Telecommunications (Miscellaneous Provisions) Act, 1996 . The Order provides for the commencement of provisions of the Act transferring to the Director of Telecommunications Regulation functions of the Minister for Transport, Energy and Communications relating to the regulation of the telecommunications, radio communications and television transmission sectors and provisions dealing with the funding of the expenses of the Director in carrying out his or her functions.
