MARITIME BOUNDARIES (COUNTY OF KERRY) ORDER, 1998 |
||
WHEREAS the Boundary Surveyor has found that certain land adjoining the county of Kerry has been reclaimed from the sea; |
||
AND WHEREAS the present acknowledged or reputed boundaries of the county of Kerry at Dingle Harbour have been ascertained, defined and marked out by the Boundary Surveyor under section 3 of the Boundary Survey (Ireland) Act, 1854; |
||
AND WHEREAS the maritime boundaries of the said county's constituent maritime denominations of land, namely, barony, parish, townland, and electoral division have been ascertained, defined and marked out under the said section 3; |
||
AND WHEREAS a report, prepared and made out by the Boundary Surveyor accompanied by a plan, has been submitted to the Government under section 11 of the said Act; |
||
NOW THEREFORE, the Government, in exercise of the powers conferred on them by sections 11 and 12 of the said Act and section 4 of the Boundary Survey (Ireland) Act, 1859, as adapted by or under subsequent enactments, and having considered the report and plan so submitted, hereby order as follows: |
||
1. (1) This order may be cited as the Maritime Boundaries (County of Kerry) Order 1998. |
||
(2) This Order shall come into operation on the 29th day of October, 1998. |
||
2. The Interpretation Act, 1937 (No 38 of 1937), shall apply to this Order. |
||
3. In this Order |
||
"the Boundary Surveyor" means James V. Rogers, Boundary Surveyor appointed under the Boundary Survey (Ireland) Act, 1854; |
||
"the Plan" means the ordnance plan referred to in and submitted with the Report; |
||
"present" in relation to a boundary, means existing immediately before the commencement of this Order; |
||
"the Report" means the report of the Boundary Surveyor, relating to the maritime boundaries of the county of Kerry at Dingle Harbour and of it's constituent denominations of land, namely, barony, parish, townlands and electoral division, dated the 21st day of September, 1998, and prepared, made out and submitted to the Secretary General to the Government, in accordance with section 11 of the Boundary Survey (Ireland) Act, 1854. |

4. It is hereby directed that for all public purposes the boundary of the county of Kerry at Dingle Harbour shall be deemed and taken to be the present boundary line as altered by the adoption of each of the changes proposed by the Boundary Surveyor which are marked out by him and described in detail in paragraph 1 of the Report and delineated on the Plan. |

5. It is hereby directed that for all public purposes the boundary of the barony of Corkaguinny shall be deemed and taken to be the present boundary line as altered by the adoption of the change proposed by the Boundary Surveyor which is described in paragraph 2 of the Report and delineated on the Plan. |
||
6. It is hereby directed that for all public purposes the boundary of the electoral division of Dingle shall be deemed and taken to be the present boundary line as altered by the adoption of the change proposed by the Boundary Surveyor which is described in paragraph 3 of the Report and delineated on the Plan. |

7. It is hereby directed that for all public purposes the boundary of the parish of Dingle shall be deemed and taken to be the present boundary line as altered by the adoption of the change proposed by the Boundary Surveyor which is described in paragraph 4 of the Report and delineated on the Plan. |

8. It is hereby directed that for all public purposes the boundary of the townland of The-Wood shall be deemed and taken to be the present boundary line as altered by the adoption of the change proposed by the Boundary Surveyor which is described in paragraph 5 of the Report and delineated on the Plan. |
||
9. It is hereby directed that for all public purposes the boundary of the townland of Farrannakilla shall be deemed and taken to be the present boundary line as altered by the adoption of the change proposed by the Boundary Surveyor which is described in paragraph 6 of the Report and delineated on the Plan. |

10. It is hereby directed that for all public purposes the boundary of the townland of Dingle shall be deemed and taken to be the present boundary line as altered by the adoption of the change proposed by the Boundary Surveyor which is described in paragraph 7 of the Report and delineated on the Plan. |
||
11. This Order together with the Report and the Plan shall remain on record in the office of the Secretary General to the Government and shall be exhibited to any person or persons who may desire to inspect the same, without fee or reward. |
||
