Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 17th February, 2012.

I, MICHAEL NOONAN T.D., Minister for Finance, in exercise of the powers conferred on me by section 14 (1) of the section 21 of the Ministers and Secretaries (Amendment) Act 2011 (No. 10 of 2011) after consultation with the Minister for Public Expenditure and Reform, hereby order as follows:

1. This Order may be cited as the Remuneration of the Comptroller and Auditor General Order 2012.

2. The annual rate of remuneration of the Comptroller and Auditor General shall be-

(a) €200,000, in respect of the holder of that office who makes a personal pension contribution, or

(b) €190,000, in respect of the holder of that office who does not make a personal pension contribution.

3. The Comptroller and Auditor General (Amendment) Act 1993 (Section 14) Order 2007 ( S.I. No. 791 of 2007 ) is revoked.

4. Notwithstanding Articles 2 and 3, this Order does not apply to the person who holds the office of Comptroller and Auditor General immediately before the making of this Order and the rates (as reduced by section 2(2B) (inserted by section 6 of the Financial Emergency Measures in the Public Interest (Amendment) Act 2011 (No. 39 of 2011)) of the Financial Emergency Measures in the Public Interest (No. 2) Act 2009 (No. 41 of 2009)) specified in the Order revoked by Article 3 continue to apply to that person while he holds such office.
