Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 23rd June, 2015.

I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Directive 2014/63/EU of the European Parliament and of the Council of 15 May 20141 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Marketing of Honey) (Amendment) Regulations 2015.

2. The European Communities (Marketing of Honey) Regulations 2003 ( S.I. No. 367 of 2003 ) are amended-

(a) in Regulation 2(1) by substituting for the definition of “Council Directive” the following-

“‘Council Directive’ means Council Directive 2001/110/EC of 20 December 20012 as amended by Directive 2014/63/EU of the European Parliament and of the Council of 15 May 2014;”, and

(b) by substituting for Regulation 4 the following-

“4.(1) A person shall not place honey on the market unless it complies with Articles 2 and 3 of the Council Directive.

(2) A person may place honey manufactured before 1 August 2004 on the market in accordance with the Regulations revoked by Regulation 10 until stocks are exhausted.

(3) A person may place honey produced or labelled before 24 June 2015 on the market in accordance with Article 3 of Directive 2014/63/EU of the European Parliament and of the Council of 15 May 2014 until stocks are exhausted.”.
