S.I. No. 498/2017 - Forestry (Amendment) Regulations 2017


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 21st November, 2017.

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 6 , 10 , 17 , 22 and 30 of the Forestry Act 2014 (No. 31 of 2014) and for the purpose of giving effect to Directive No 2011/92/EU of the European Parliament and of the Council of 13 December 20111 as amended by Directive 2014/52/EU of the Parliament and of the Council of 16 April 20142 , insofar as it applies to development consent in respect of certain proposed forestry related activities, hereby make the following regulations:

1. These Regulations may be cited as the Forestry (Amendment) Regulations 2017.

2. The Forestry Regulations 2017 ( S.I. No. 191 of 2017 ) are amended by substituting Regulation 13(3) for the following:

(3) A person shall—

“(a) in respect of development referred to in paragraphs (2)(a) or (2)(b), submit-

(i) an EIS with his or her application, and

(ii) details of registration of the application requiring environmental impact assessment with the Minister for Housing, Planning and Local Government, or

(b) in respect of development referred to in paragraph (2)(c) or (2)(d), on request from the Minister, submit-

(i) an EIS to accompany his or her application, and

(ii) details of registration of the application requiring environmental impact assessment with the Minister for Housing, Planning and Local Government.”.
