I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2018/1027 of 19 July 20181 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Cereal Seed) (Amendment) Regulations 2018. | ||
2. The European Union (Cereal Seed) Regulations 2013 ( S.I. No. 217 of 2013 ) are amended in Regulation 2(1) by substituting for the definition of “Directive” (as amended by the European Union (Cereal Seed) (Amendment) Regulations 2017 ( S.I. No. 214 of 2017 )) the following: | ||

3. The following Regulations are revoked: | ||
(a) The European Union (Cereal Seed) (Amendment) Regulations 2016 ( S.I. No. 375 of 2016 ) | ||
(b) The European Union (Cereal Seed) (Amendment) Regulations 2017 ( S.I. No. 214 of 2017 ). | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation) | ||
These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2018/1027/ which amends Council Directive 66/402 as regards the isolation distances for sorghum spp. | ||
Council Directive 66/402 sets down the principles by which cereal seed is marketed within the Community. The Directive requires each Member States implements controls to ensure cereal seed may not be placed on the market unless it has been officially certified as “basic seed”, “certified seed”, “certified seed, first generation” or “certified seed, second generation” and unless it satisfies the conditions set down in the accompanying Annexes. | ||
