Notice of the making of this Statutory Instrument was published in | ||

I, HELEN MCENTEE, Minister for Justice, in exercise of the powers conferred on me by paragraph (d) of section 122 (1) (as amended by section 56(a) of the Garda Síochána (Policing Authority and Miscellaneous Provisions) Act 2015 (No. 49 of 2015)) and 128 (2) of the Garda Síochána Act 2005 (No. 20 of 2005) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )) and section 59(2) of the Garda Síochána (Policing Authority and Miscellaneous Provisions) Act 2015 (as so adapted), after consulting with the Garda Commissioner and the Policing Authority and with the approval of the Government, hereby make the following regulations: | ||
1. These Regulations may be cited as the Garda Síochána (Admissions and Appointments) (Amendment) Regulations 2021. | ||
2. In these Regulations, “Regulations of 2013” means the Garda Síochána (Admissions and Appointments) Regulations 2013 ( S.I. No. 470 of 2013 ). | ||
3. The Regulations of 2013 are amended in Regulation 4 - | ||
(a) in paragraph (b)(i), by the substitution of the following clause for clause (II): | ||
“(II) is entitled under section 53, 56, 57 or 59 of the International Protection Act 2015 (No. 66 of 2015) to the rights and privileges specified in section 53 of that Act,”, | ||
(b) in paragraph (b)(ii), by the substitution of the following clause for clause (II): | ||
“(II) it consists of a period during which the person was entitled to remain in the State in accordance only with - | ||
(a) section 9 (2) of the Refugee Act 1996 (No. 17 of 1996), or | ||
(b) section 16 of the International Protection Act 2015 (No. 66 of 2015),” | ||
(c) in paragraph (c), by the substitution of the following subparagraph for subparagraph (i): | ||
“(i) a grade of not less than D3 or O6, as the case may be, in 5 subjects at not lower than ordinary level in the Leaving Certificate Examination,”, and | ||
(d) by the substitution of the following paragraph for paragraph (d): | ||
“(d) he or she is proficient in either or both of the following: | ||
(i) the Irish language; | ||
(ii) the English language.”. | ||
The Government hereby approve of the making of the foregoing Regulations. | ||
