I, HEATHER HUMPHREYS, Minister for Social Protection, in exercise of the powers conferred on me by sections 2 (2) (amended by the schedule to the Social Welfare Act 2019 (No. 34 of 2019)), 3 (amended by section 12 of the Social Welfare and Pensions Act 2015 (No. 47 of 2015)), 4 (amended by section 10 of the Social Welfare Act 2020 (No. 30 of 2020)), 41 (amended by section 5 of the Social Welfare Act 2016 (No. 15 of 2016)), 53 (amended by section 16 of the Social Welfare (Miscellaneous Provisions) Act 2016 (No. 22 of 2008)), 64 (amended by section 3 of the Social Welfare Act 2019 (No. 34 of 2019)), 109 (amended by sections 9 , 17 and schedule 1 to the Social Welfare Pensions and Civil Registration Act 2018 (No. 37 of 2018)), 125 (amended by section 6 of the Social Welfare Act 2011 (No. 37 of 2011)), 178A (amended by section 17 and schedule 1 to the Social Welfare Pensions and Civil Registration Act 2018 (No. 37 of 2018)) and 297 (amended by section 26 and schedule 3 to the Social Welfare and Pensions Act 2010 (No. 37 of 2010)) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), with the consent of the Minister for Public Expenditure and Reform, hereby make the following Regulations:

Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 16) (Change in Rates) Regulations 2022.

(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2022 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2022.

Commencement

2. These Regulations come into operation–

(a) in so far as they relate to jobseeker’s allowance, pre-retirement allowance and farm assist, on 28 December 2022,

(b) in so far as they relate to jobseeker’s benefit and jobseeker’s benefit (self-employed) on 29 December 2022,

(c) in so far as they relate to illness benefit, health and safety benefit and injury benefit on 2 January 2023,

(d) in so far as they relate to disability allowance, on 4 January 2023,

(e) in so far as they relate to invalidity pension and a payment referred to in paragraph (a) of the definition of “relevant payment” in section 178 (1) of the Social Welfare Consolidation Act 2005 on 5 January 2023, and

(f) in so far as they relate to State pension (contributory), widow’s (contributory) pension, widower’s (contributory) pension and surviving civil partner’s (contributory) pension, on 6 January 2023.

Amendment of Schedules to Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007

3. The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) are amended–

(a) by the substitution of the Schedule set out in Schedule 1 to these Regulations for Schedule 1,

(b) by the substitution of the Schedules set out in Schedule 2 to these Regulations for Schedules 2 and 2A,

(c) by the substitution of the Schedules set out in Schedule 3 to these Regulations for Schedules 3 and 3A,

(d) by the substitution of the Schedule set out in Schedule 4 to these Regulations for Schedule 4,

(e) by the substitution of the Schedules set out in Schedule 5 to these Regulations for Schedules 5, 6 and 6A,

(f) by the substitution of the Schedule set out in Schedule 6 to these Regulations for Schedule 7,

(g) by the substitution of the Schedules set out in Schedule 7 to these Regulations for Schedules 8, 8A and 8B,

(h) by the substitution of the Schedule set out in Schedule 8 to these Regulations for Schedule 9, and

(i) by the substitution of the Schedule set out in Schedule 9 to these Regulations for Schedule 11.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The Social Welfare Act 2022 provides for increases in the maximum rates of certain social insurance payments arising from Budget 2023. These rates will apply where the contribution conditions and relevant weekly earnings or weekly income conditions are fully satisfied.

Where contribution conditions are partially satisfied, the Social Welfare Consolidation Act provides for Regulations to specify the reduced personal rates and for tapered increases for a qualified adult (where such a qualified adult has a weekly income).

These Regulations provide for increases to the reduced personal rates of Illness Benefit, Jobseeker’s Benefit, Jobseeker’s Benefit (Self-Employed), Health and Safety Benefit, State Pension (Contributory), Widow’s (Contributory) Pension, Widower’s (Contributory) Pension, and Surviving Civil Partner’s (Contributory) Pension. The reduced rates applicable for qualified adults in such cases are also increased.

These Regulations also provide for changes to the rates of tapered increases for qualified adults (whose income is between €100.01 and €310.00), of recipients of Illness Benefit, Jobseeker’s Benefit, Jobseeker’s Benefit (Self-Employed), Injury Benefit, Jobseeker’s Allowance, Pre-Retirement Allowance, Disability Allowance, Farm Assist and Invalidity Pension.

Finally these Regulations provide for changes to the tapered increases for qualified adults (whose income is between €100.01 and €310.00), of recipients who are on reduced rates of State Pension (Contributory), Illness Benefit, Jobseeker’s Benefit and Jobseeker’s Benefit (Self-Employed).

These changes will take effect from 28 December 2022 to 6 January 2023 to coincide with the increases to the maximum rates for the schemes in question provided for in the Social Welfare Act 2022.
