Trusts-trust assets-mistake by settlor/donor-voluntary transfer into trust set aside if court satisfied (i) mistake by settlor/donor; (ii) settlor/donor would not have entered transaction "but for" mistake; and (iii) mistake so serious that unjust for donee to retain property-transfer set aside if mistaken belief (from incorrect advice) that original owners could access assets and nominate beneficiaries to receive assets after death, whereas assets in fact inaccessible for duration of trust
