ROYAL COURT

(Samedi Division)

16 April 1999

Before: Sir Philip Bailhache Kt Bailiff, and

Jurats Potter and Le Brocq

Ex parte Representation of Robert John Young alleging breaches of the

European Convention on Human Rights

The Representor on his own behalf

JUDGMENT

BAILIFF: The position of the Representor is that he is a convicted prisoner at La Moye Prison having been convicted of offences by the Royal Court. His application for leave to appeal against conviction and sentence has been dismissed by the Court of Appeal. He has a right to make an application for special leave to appeal to the Privy Council but we understand from the Representor that he has not yet decided whether he will pursue that avenue of appeal. He also has a right to make a complaint to the European Commission of Human Rights but again we understand from the Representor that an application of that kind has not yet been brought to fruition. So far as this representation is concerned it raises no justiciable issue which this Court has a jurisdiction to deal with. The representation has no substance and is accordingly dismissed.
