Sentencing by the Inferior Number of the Royal Court on a breach of a Community Service Order imposed on 15^th May, 2009, on the following charges:

1 count of:

Grave and criminal assault (Count 1).

Age:  23.

Plea: Guilty.

Conclusions:

Breach of Community Service order:  3 months' imprisonment.

Sentence and Observations of Court:

Conclusions granted.

Community Service Order discharged.

JUDGMENT

THE DEPUTY BAILIFF:

1.        Mr Wallace, you were sentenced by the Royal Court on 15^th May, 2009 for the offence of grave and criminal assault, which was an assault where you struck a man in the early hours of the morning with a beer can, and you struck him on the head.  You were ordered to complete 150 hours' community service and the Court has now had you back before it in the light of the failures to comply with that order and also to perform the community service ordered by the Court last October for your breach of the original order. 

2.        The Crown has moved for a sentence of 3 months' imprisonment.  We have noted that you have appeared before us to accept that a custodial sentence is inevitable because you are not willing to perform the Community Service Order as imposed. 

3.        Taking into account the hours which you have already worked, we think the Crown's conclusions of 3 months' imprisonment are correct and you will therefore go to prison for 3 months on the original offence. 

4.        The Community Service Order is therefore discharged.
