THE INDUSTRIAL TRIBUNALS
CASE REF: 2861/11
CLAIMANT: Mary Robinson
RESPONDENT: Gary Anderson t/a LA Cabs
DECISION
The decision of the tribunal (Chairman sitting alone) is that the claimant is awarded the sum of £4,617.20.
Constitution of Tribunal:
Chairman (sitting alone): Ms J Knight
Appearances:
The claimant appeared in person and represented herself.
The respondent did not appear and was not represented.
Having heard the evidence of the claimant, the tribunal reached the following findings of fact and conclusions:
1. The title of the respondent was amended to that now shown. The claimant was continuously employed by the respondent for 14 full years until the effective date of dismissal on 18 August 2011 when she was told not to come into work the next day. She was not given written terms and conditions of employment. At the date of termination, the claimant was 63 years old and her gross and net weekly earnings were £132.00 and £118.00 respectively. I accepted the claimant’s evidence that the holiday year ran from 1 January until 31 December and that she had 7 outstanding days holiday left at the date of termination. I am satisfied that the reason for the termination of employment was redundancy. She was not paid notice pay, holiday pay or a redundancy payment
2. The award of £4,617.20 is comprised of £2,772.00 redundancy pay; £1,416.00 notice pay pursuant to Article 118 of the Employment Rights (NI) Order 1996, £165.20 holiday pay and £264.00 pursuant to Article 27 of the Employment (NI) Order 2003 as the claimant was not provided with a statement of the particulars of her employment.
3. Full reasons were given at the hearing.
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
