DECISION ON A PRE-HEARING REVIEW

 

By agreement, it was decided that a discovery order should be made in favour of the respondent in respect of all of the claimant’s GP’s notes and records, and all of the OHS notes and records in respect of the claimant, to which (in both instances) both of the following conditions apply:

 

(1)          They related to her mental health issues and difficulties.

 

(2)          Those notes and records were recorded, or made, during the period beginning in June 2005 and ending on the date of the hearing of the Pre-Hearing Review.

REASONS

 

1.         The parties were agreed that I should grant a discovery order to the extent indicated above.

 

2.         A deadline of 23 April 2014 was imposed in respect of the provisions of the relevant records.
