DECISION

The decision of the tribunal is that the respondent is ordered to pay to the claimant compensation for unfair dismissal amounting to £19,679.80 and compensation for race discrimination of £10,000.00.

The claimant was represented by Mr Oisin Toner, Solicitor of CGS Solicitors.

The respondent did not appear nor was represented.

 

1. The claimant brought a claim for unfair dismissal, breach of contract and race discrimination on 12 December 2017.

 

2. The respondent did not enter a response to this claim.

 

3. On 21 February 2018 I made a default judgement on liability only in which I upheld the claimant's complaint of unfair dismissal, breach of contract and race discrimination. I directed that a remedy hearing would take place.

 

4. The remedy hearing took place on today 29 March 2018.

 

5. On the basis of the evidence before me I am satisfied that the claimant was unfairly dismissed and automatically unfair dismissed and is entitled to compensation of £19,679.80 I am further satisfied that she is entitled to compensation for her injury to feelings for the race discrimination suffered by the claimant which I measure at £10,000.00. The compensation is made up as follows.

 

6. Basic Award of £275.15

 

Compensatory Award of £12,936.43

 

A Statutory Uplift of 50% of £6,468.22

 

Compensation to Injury to Feelings of £10,000.00

 

7. Reasons for my decision were given at the hearing.

 

8. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
