THE INDUSTRIAL TRIBUNALS
CASE REF: 12283/18
CLAIMANT: Jurijus Afanasenkov
RESPONDENTS: 1. Manfreight Haulage
2. Patricia Edgar
DECISION
1. The first-named respondent made unauthorised deductions from the wages of the claimant. The first-named respondent is ordered to pay to the claimant the sum of £345.00.
2. The claim against the second-named respondent is dismissed in its entirety.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Browne
Appearances:
The claimant appeared in person.
1. The relevant time limit for the respondents to present a response has expired. No response has been presented.
2. It having been determined that a default judgment was not appropriate, I conducted a hearing by receiving evidence from the claimant through an interpreter, namely his wife.
3. As expressed in my reasons delivered orally at the hearing I am satisfied from his evidence and from the written materials that the first-named respondent made unauthorised deductions from the wages of the claimant to a total amount of £345.00.
4. The first-named respondent is therefore ordered to pay £345.00 to the claimant.
5. I also ordered that the case against the second-named respondent should be dismissed in its entirety.
6. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
