THE INDUSTRIAL TRIBUNALS

CASE REF:  18/19

CLAIMANT:                          Aleksandra Kalinowska

RESPONDENT:                  Keith Tierney

DECISION

The tribunal is satisfied that the respondent failed to pay the claimant for 23 days’ holiday entitlement.  The respondent is ordered to pay to the claimant the sum of £1,156.00.

CONSTITUTION OF TRIBUNAL

Employment Judge (sitting alone):       Employment Judge Browne

APPEARANCES:

The claimant was self-represented.

The respondent was not present or represented.

1.       The relevant time limit for the respondent to present a response has expired. No response has been presented.

2.       It having been determined that a default judgment was not appropriate, I conducted a hearing by receiving information from the claimant and examining documentation brought by her to the hearing.

3.       As expressed in my reasons delivered orally at the hearing, I am satisfied from this information and from the written materials that the respondent’s failure to pay to the claimant 23 days’ holiday pay was a breach of her contract of employment to a total amount of £1,156.00.  The respondent is therefore ordered to pay £1,156.00 to the claimant.

4.       This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.

Employment Judge:

Date and place of hearing:   4 April 2019, Belfast.

Date decision recorded in register and issued to parties:
