THE INDUSTRIAL TRIBUNALS

CASE REF:  18791/19

CLAIMANT:                          Linda Cass

RESPONDENT:                  Amt-Sybex Ltd t/a Capita PLC

JUDGMENT

The unanimous judgment of the tribunal is that the claims before the tribunal should be struck out under Rule 32 of Schedule 1 to the Industrial Tribunals and Fair Employment Tribunal (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2020.  The judgment was given orally, with reasons, at the end of the hearing.

CONSTITUTION OF TRIBUNAL

Vice President:                                           Mr N Kelly

Members:                                                     Ms K Stewart

                                                                        Mr J Norney

APPEARANCES:

The claimant appeared in person and was not represented.

The respondent was represented by Ms Pickerton, Barrister-at-Law, instructed by Sheena Murphy Solicitors.

1.         The claimant applied for a postponement of this matter which had been listed for hearing from 7 June 2021 to 11 June 2021.  That application was refused and that decision was given, again with reasons, in the course of the hearing.

2.         The respondent applied for the claims before the tribunal to be struck out under Rule 32 on the basis that the claimant had repeatedly failed to comply with Orders of the tribunal, that her conduct had been frivolous, unreasonable and vexatious and that the claims had no reasonable prospect of success.

3.         After hearing from the parties, an oral judgment, with reasons, was given at the end of the hearing striking out all claims before the tribunal on all of those grounds.

Vice President:

Date and place of hearing:          7 June 2021, Belfast.

This judgment was entered in the register and issued to the parties on:
