[2001] NISSCSC A2/01-02(ICA) (28 January 2002)
Application No: A2/01-02(ICA)
SOCIAL SECURITY (NORTHERN IRELAND) ORDER 1998
INVALID CARE ALLOWANCE
Application by the above-named for
leave to appeal to a Social Security Commissioner
on a question of law from a Tribunal's decision
dated 2 January 2001
DETERMINATION OF THE SOCIAL SECURITY COMMISSIONER
Having considered the circumstances of the case and any reasons put forward in the request for a hearing, I am satisfied that the application can properly be determined without a hearing.
Having read the case papers it does not appear that there is any valid ground for holding that the decision of the Appeal Tribunal is or may be erroneous in point of law. In particular it is not reasonably arguable that the decision of the Tribunal in any way breached the rules of natural justice. In addition it is noteworthy that the papers in this case make it clear that the claimant had been previously sent a sum of money as a back payment but she decided that this sum should not be used to pay off any arrears.
Leave to appeal is accordingly refused.
(Signed): JOHN A H MARTIN QC
CHIEF COMMISSIONER
(Dated): 28 January 2002
