BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - LONG TITLE An Act to amend the law relating to the registration of births, deaths and marriages, and the licensing of marriages; to dispense with notifications of deaths of certain persons; and for purposes connected with the matters aforesaid. [5th June 1956] Districts and OfficersRegistration districts and registration authorities. [ BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 1 1.(1) Each local government district shall be a registration district and the district council shall be the local registration authority for the purposes of this Act. (2) A district council shall, in the exercise of the functions conferred on it as a local registration authority, (a)act as agent for the Ministry of Finance; and (b)act in accordance with such directions as the Ministry may give to the council; Registrars and other staff. [ BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 2 2.(1) Subject to the provisions of this section, a local registration authority, with the approval of the Registrar General, shall appoint a registrar of marriages and one or more deputy registrars of marriages. (2) A person holding an appointment under sub-section (1) may be removed from his office of registrar or deputy registrar by the local registration authority, with the approval of, or at the direction of, the Registrar General.][ BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 3 Financial provisions. 3. The Ministry shall retain or, as the case may be, defray in respect of each financial year the amount of the difference between (a)the aggregate of the amounts of salaries, superannuation and other expenses payable by virtue of this Act in respect of any registration district; and (b)the aggregate of the amounts received in that registration district under any enactment or otherwise by way of fees or other expenses. Delegation of power to grant special licences for marriages. BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 9 9. Where by any enactment any authority, body or person is empowered to grant special licences for the solemnization at any convenient times or places of marriages between persons of whom one or both belongs, or belong, to any church or religious denomination specified in the enactment, the Governor may on the recommendation of the Registrar General appoint any person nominated by that authority, body or person to exercise that power as deputy in, or in respect of, such district and subject to such terms and conditions as shall be specified in the instrument of appointment. BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 10 Certificates of notice of marriage. 10. Where a marriage is to be solemnised by licence, the certificate of notice thereof required by section sixteen of the Marriages (Ireland) Act, 1844, may be required to be given only where the parties dwell in the districts of different registrars and only by the registrar in whose district the marriage is not intended to be so solemnised, and accordingly ... residue amends s.16 of 1844 c.81 BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 11 Manner of forbidding issue of registrar's licence or certificate under Act of 1844. 11. Where either party to an intended marriage is a minor, the issue of any such certificate as is referred to in section seventeen of the Marriages (Ireland) Act, 1844, or the grant of a licence under section twenty-one of that Act may be forbidden by any person whose consent to the marriage of that party is requisite under sub-section (1) of section one of the Marriages Act (Northern Ireland), 1954, and accordingly ... residue amends s.18 of 1844 c.81 S.12 amends s.3 of 1863 c.27. In this Act the expression "enactment" includes an Act of Parliament and an Act of the Parliament of the United Kingdom, and any instrument made under any such Act; Definitions rep. by 1967 c.25 (NI) s.65 sch.3; 1973 NI 8 art.9 sch.3 "registrar of marriages" means a registrar for the purposes of the Marriages (Ireland) Act, 1844 [and the Registration of Marriages (Ireland) Act 1863]. BIRTHS, DEATHS AND MARRIAGES REGISTRATION ACT (NORTHERN IRELAND) 1956 - SECT 21 1863 c.90 21.(1) This Act may be cited as the Births, Deaths and Marriages Registration Act (Northern Ireland), 1956.
