LIVESTOCK (PROTECTION FROM DOGS) ACT (NORTHERN IRELAND) 1968 LIVESTOCK (PROTECTION FROM DOGS) ACT (NORTHERN IRELAND) 1968 - LONG TITLE An Act to make further provision for the protection of livestock from dogs and with respect to dangerous dogs; and for purposes connected therewith. [11th June 1968] Worrying of livestock. LIVESTOCK (PROTECTION FROM DOGS) ACT (NORTHERN IRELAND) 1968 - SECT 1 1.(1) Subject to the provisions of this section, if a dog worries livestock on any land (in this section referred to as "the relevant land"), the owner of the dog and, if it is in the charge of a person other than its owner, that person also, shall be guilty of an offence under this section and be liable on summary conviction to a fine not exceeding twenty pounds or, in the case of a second or subsequent conviction in respect of the same dog, to a fine not exceeding fifty pounds. (2) Except where a person causes a dog to attack livestock, he shall not be guilty of an offence under this section by reason of anything done by the dog, if at the material time the livestock are trespassing on the relevant land and the dog is owned by, or in the charge of, the occupier of that land or a person authorised by him to remove the livestock from that land. (3) The owner of a dog shall not be convicted of an offence under this section in respect of the worrying of livestock by the dog if he proves that at the time when the dog worried the livestock it was in the charge of some other person whom he reasonably believed to be a fit and proper person to be in charge of the dog. (4) Proceedings for an offence under this section shall not be brought except (a)by or with the consent of a district inspector of the Royal Ulster Constabulary acting for the area in which the relevant land is situated; (b)by the occupier of the relevant land; (c)by the owner of any of the livestock in question. (5) In this section "livestock" and "worrying livestock" have the meanings assigned to them by section 1(4) of the Dogs Act (Northern Ireland) 1960. S.2 adds s.2(2)(3) to 1871 c.56. S.3 (rep. in pt. by 1976 NI13 art.14 sch.) substitutes s.1(4)(7) of 1906 c.32. S.4 amends s.1 of 1960 c.6 (NI) LIVESTOCK (PROTECTION FROM DOGS) ACT (NORTHERN IRELAND) 1968 - SECT 5 Power to make regulations with respect to dogs. 5.(1) With a view to the protection of livestock from dogs the Ministry of Agriculture may make orders for all or any of the following purposes: (a)for prescribing and regulating the muzzling of dogs, and the keeping of dogs under control; (b)for prescribing and regulating the wearing by dogs of a collar with the name and address of the owner inscribed on the collar or on a plate or badge attached thereto; (c)for preventing dogs, or any kind of dogs, from straying during all or any of the hours between sunset and sunrise; (d)for providing that any dog in respect of which an offence is being committed against provisions made under either of the two last foregoing paragraphs may be seized and treated as a stray dog under the enactments relating to dogs; (e)for prescribing and regulating the seizure, detention and disposal (including destruction) of stray dogs, and of dogs not muzzled, and of dogs not being kept under control, and the recovery from the owners of dogs of the expenses incurred in respect of their detention. (2) A person contravening any provision of an order made under this section shall be guilty of an offence and be liable on summary conviction to a fine not exceeding twenty pounds. (3) An order made under this section shall be subject to negative resolution. Subs.(4) repeals s.27 of 1958 c.13 (NI) LIVESTOCK (PROTECTION FROM DOGS) ACT (NORTHERN IRELAND) 1968 - SECT 6 Short title. 6. This Act may be cited as the Livestock (Protection from Dogs) Act (Northern Ireland) 1968.
