WELFARE FOODS ACT (NORTHERN IRELAND) 1968 WELFARE FOODS ACT (NORTHERN IRELAND) 1968 - LONG TITLE An Act to empower the Ministry of Health and Social Services to make arrangements for the provision of welfare foods and for purposes connected with that matter. [12th December 1968] Distribution etc. of welfare foods. WELFARE FOODS ACT (NORTHERN IRELAND) 1968 - SECT 1 1.(1) The Ministry of Health and Social Services (in this Act referred to as "the Ministry") may make arrangements, to be administered by or on behalf of the Ministry (a)for the provision of any welfare food; and (b)for the making of payments to such qualified persons as may be determined by or under the arrangements. (2) In subsection (1)(b) "qualified persons" means persons who are entitled to receive a welfare food under arrangements made in pursuance of subsection (1)(a), but who either (i)do not receive a welfare food to which they are so entitled; or (ii)do not receive the amount to which they are so entitled of a welfare food; (3) For the purpose of giving effect to any arrangements made under subsection (1), the Ministry may make regulations (a)providing for (i)the acquisition, treatment, keeping, storage, transport, distribution or disposal, by or on behalf of the Ministry of any welfare food other than liquid milk, and the use or consumption of any such food; and (ii)the disposal, use or consumption of liquid milk; (b)controlling the prices to be charged for any welfare food. (4) Regulations under subsection (3) shall be subject to negative resolution and any power to make regulations conferred by paragraph (b) of that subsection shall be exercisable only with the consent of the Ministry of Finance. WELFARE FOODS ACT (NORTHERN IRELAND) 1968 - SECT 2 Offences. 2.(1) If any person (a)with intent to obtain any welfare food under this Act or any sum under this Act, either in his own right or on behalf of another, furnishes any information which he knows to be false in a material particular, or recklessly furnishes any information which is false in a material particular, or withholds any material information; or (b)obtains or receives any welfare food under this Act or any sum under this Act, either in his own right or on behalf of another, knowing that it was not properly receivable by, or not properly payable to, him; (2) If any person contravenes any regulations made under section 1, he shall be guilty of an offence under this Act. (3) If, otherwise than in accordance with regulations made under section 1, any person disposes, for any valuable consideration, of any document issued to him for the purposes of this Act or of any regulation made under section 1, he shall be guilty of an offence under this Act. WELFARE FOODS ACT (NORTHERN IRELAND) 1968 - SECT 3 Penalties and legal proceedings. 3.(1) A person guilty of an offence under this Act shall be liable on summary conviction to imprisonment for a term not exceeding three months or to a fine not exceeding one hundred pounds, or to both. (2) Proceedings for an offence under this Act shall not be instituted except by the Ministry or by or with the consent of the Attorney General. (3) Notwithstanding section 34 of the Magistrates' Courts Act (Northern Ireland) 1964, proceedings for an offence under this Act may be commenced at any time within twelve months after the date on which the offence was committed or within three months after the date on which evidence sufficient to justify the proceedings comes to the Ministry's knowledge, whichever period last expires. (4) For the purposes of subsection (3) a certificate of the Ministry as to the date on which such evidence as aforesaid came to the Ministry's knowledge shall be prima facie evidence. S.4 rep. by SLR 1976 WELFARE FOODS ACT (NORTHERN IRELAND) 1968 - SECT 5 Interpretation. 5.(1) In this Act "welfare food" means liquid milk, dried milk, concentrated orange juice, cod liver oil or vitamin tablets [Vitamins A, D and C combined in liquid form]. (2) The Ministry may, by regulations made subject to affirmative resolution, add any food to or remove any food from the foods referred to in subsection (1).
