Citation and Commencement

1. This Order may be cited as the Plant Health (Amendment) Order 2010 and shall come into operation on 25th June 2010.

Amendments to the Plant Health Order (Northern Ireland) 2006

2. The Plant Health Order (Northern Ireland) 2006(5) shall be amended in accordance with Article 3.

3. In article 2(1), at the appropriate place in accordance with alphabetical order insert–

"Directive 2010/1/EU" means Council Directive 2010/1/EU amending Part B of Annex IV to Council Directive 2000/29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community(6)"

4. In Schedule 4, Part C–

(a) for the wording in paragraph (c) in the third column of item 12, substitute–

"the plants originate in the Cantons of Valais in Switzerland; or";

(b) for the wording in paragraph (b) in the third column of item 13, substitute–

"the plants originate in the Cantons of Valais in Switzerland; or".

This Order amends the Plant Health Order (Northern Ireland) 2006 (S.I. 2006/82) so as to implement Commission Directive 2010/1/EU amending Annexes II,III and IV to Council Directive 2000/29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (O.J. L.7,12.1.2010.p.17 as last amended by Commission Directive 2000/29/EC, O.J. No. L.169, 10.7.2000, p.1).
