The Police Service of Northern Ireland (Amendment) Regulations 2015

The Department of Justice, in exercise of the powers conferred by section 25 of the Police (Northern Ireland) Act 1998(1), makes the following Regulations. Those powers are now vested in the Department(2).

The Department has taken into consideration the recommendations made by the Police Negotiating Board for the United Kingdom and supplied the Board with a draft of the Regulations in accordance with section 62(1ZA) of the Police Act 1996(3).

Citation and commencement

1.  These Regulations may be cited as the Police Service of Northern Ireland (Amendment) Regulations 2015 and shall come into operation on 5th October 2008.

Amendment of the Police Service of Northern Ireland Regulations 2005

2.-(1) The Police Service of Northern Ireland Regulations 2005(4) shall be amended in accordance with paragraph (2).

(2) In regulation 23(3)-

(a)for sub-paragraph (f) substitute-

"(f)in the case of a female member who has taken one or more periods of maternity leave, in respect of each maternity period-

(i)where that leave has been for 52 weeks or more, account shall be taken of the first 52 weeks whilst on maternity leave;

(ii)where that leave has been for less than 52 weeks, account shall be taken of any period spent on maternity leave;";

(b)in sub-paragraph (g) for "32(8)(c)" substitute "32(8)(a)";

(c)for sub-paragraph (h) substitute-

"(h)in the case of a member who has taken one or more periods of adoption leave, account shall be taken of any period of such leave taken in accordance with a determination under regulation 32(8)(c).".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Service of Northern Ireland Regulations 2005 in respect of the periods of maternity and adoption leave to be taken into account in reckoning the length of service of a member of the Police Service of Northern Ireland, for the purpose of determining the member's pay.

1998 c.32. Relevant amendments are made by section 78(1) of and paragraph 23 of Schedule 6 to the Police (Northern Ireland) Act 2000.

(2)

Article 5 of and paragraph 9 of Schedule 3 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order (S.I. 2010/976) transferred the regulation making powers of the Secretary of State to the Department of Justice.

1996 c.16. Section 62(1ZA) was inserted by article 5 of and paragraph 7(3) of Schedule 3 to S.I. 2010/976.
