Special case, in which the Court found that the grounds of action were not set forth in the summons in terms sufficiently positive and consistent, and that the conclusions were not regularly or legally deduced; and therefore dismissed the action, with expenses, reserving to the pursuer to bring such competent action as he might be advised.
