This was a special case. John Macnee, shorthand writer in Edinburgh, raised an action in the Sheriff Court of Edinburgh against Mrs Dow, who was confirmed executrix qua relict of John Dow, W.S,, and also against James Bridges, W.S., for payment, 1st, Of an alleged balance of account due to him by the late Mr Dow; and, 2d, Of an account for business in assisting to wind up Mr Dow's affairs, for which it was said that Mr Bridges, who had taken some friendly interest in these affairs, had made himself liable. The pursuer failed to establish his case, and the Sheriff assoilzied. The pursuer advocated, and the Lord Ordinary remitted simpliciter and subjected him in the expenses incurred in both courts. He reclaimed; but the Court adhered.
