UNDER THE FATAL ACCIDENTS AND SUDDEN DEATHS INQUIRY (SCOTLAND) ACT 1976

 

 

 

Certified Copy of the Determination made by William Seith Stanners Ireland, Esquire, Sheriff of North Strathclyde at Kilmarnock on 21 October 2009 following the Inquiry under the said Act into the circumstances of the death of Robert Brown, born 4 March 1950, of 14 Barnweil Drive, Hurlford.

 

 

The Sheriff, having considered the evidence and submissions

 

The Sheriff DETERMINES as follows:-

 

1.             In terms of section 6(1)(a) of the Fatal Accidents and Sudden Deaths Inquiry (Scotland) Act 1976 that Robert Brown, born 4 March 1950, and who latterly resided at 14 Barnweil Drive, Hurlford, Kilmarnock, died at 14.50 pm on 17 March 2009 at Crosshouse Hospital, Kilmarnock, Ayrshire.

 

2.             In terms of section 6(1)(b) of the Act that the cause of his death was a) pulmonary thrombo-embolism b) immobility due to pelvic fracture c) fall from vehicle at work, he having fallen and fractured his left pelvis when exiting a refuse vehicle in the course of his employment with East Ayrshire Council, London Road, Kilmarnock on 9 March 2009.

 

3.             In terms of section 6(1)(c) of the Act that there were no reasonable precautions whereby the death might have been avoided.

 

4. In terms of section 6(1)(d) of the Act there were no defects in any system of working which contributed to the death.
